SAN DIEGO—A federal judge issued a worldwide injunction Tuesday immediately stopping enforcement of the military's "don't ask, don't tell" policy, suspending the 17-year-old ban on openly gay U.S. troops.

U.S. District Judge Virginia Phillips' landmark ruling also ordered the government to suspend and discontinue all pending discharge proceedings and investigations under the policy.

U.S. Department of Justice attorneys have 60 days to appeal. Pentagon and Department of Justice officials said they are reviewing the case and had no immediate comment.

The injunction goes into effect immediately, said Dan Woods, the attorney who represented the Log Cabin Republicans, the gay rights group that filed the lawsuit in 2004 to stop the ban's enforcement.

"Don't ask, don't tell, as of today at least, is done, and the government is going to have to do something now to resurrect it," Woods said. "This is an extremely significant, historic decision. Once and for all, this failed policy is stopped. Fortunately now we hope all Americans who wish to serve their country can."

Legal experts say the Obama administration is under no legal obligation to appeal and could let Phillips' ruling stand.

If I were a betting man.....my money says they (the administration)do nothing,thereby achieving a noble and just goal without confronting the forces of darkness(the right wing).

My reply: I don't think this is as big of an issue for the electorate as gay marriage is. I think there is a solid block out there who may be against gay marriage (for purely selfish financial reasons, not wanting to share the financial benefits of marriage with gays) but who also don't care if the gays serve in the military.

Every wedge issue just seems to keep getting dragged up in this season. I'm sure abortion will hit the headlines any day. Does this judge even have the legal authority to issue such a decree?

This policy was dead/dying one way or another.

I don't think it's how the administration wanted it to go down (preferring a legislative solution), but they'll probably leave it there unless someone outside challenges it.

It seems they may challenge it themselves, based on some bizarre legal and social theories.

They have 60 days to challenge it. That takes us past the election.

But the Pentagon's report isn't due until December, making waiting for it problematic.

That they want to end it is clear. By sudden decree is just not the way they wanted to go.

Ending it is the official administration position but Gates has never been fully on board with that.

I think that's where the problem lies.
