My former boss also sexually harassed me... He told me that if allowed him to play with me, he would give me all day shifts so i could be with my daughter at night...
 
i turned the bastard in {including all of the emails he ever wrote me} and he still has his job...

That really, really, sucks out loud.  That may happen in small businesses, but in mine the perpetrator would be out in his ass in a matter of minutes.  I work in a no tolerence work place when it comes to any kind of harrassment.

Always amazing to see what some "consultant" will sell a company on to make more money. And the idiot in the company that buys into it.  Instead of just treating their people right. She would win if I were on the jury. Sorry to hear that the guy is still there kitten, that was not right.

As for the artical: if it was a volenteer team building event then she shouldn't have participated. It's amazing how some people want to hold others responsible for their participation in things, instead of hold themselves responsible.

I am going to agree with you on this one, yeah Kevin what the hell now? And, when it is voluntary---one can refuse on the basis of a "hostile environment" as for kittens scenario, that happens all too often protected by the GOB syndrome.

This sounds like a clear case of sexual harassment.  you should have filed a claim with your local agency or the EEOC.  You have to file your claim within 180 or 300 days, depending on if your state has an EEOC-approved local agency.  If it does, and most do, then you have 300 days.

I dont see anything wrong with their team building exercise, sounds like a bit of fun to me. If people didnt want to participate, doesnt sound like they were forced to. Heck if I was there, bring on the paddles, I woulda refused the diapers though, thats my one hard limit on my profile i think lol.

In australia once a year there is a fund raising thing for cancer, people volunteer to have all their hair shaved off to raise money, I would imagine there are a lot of people who just wouldnt participate because it would be too embarressing for them, yet others do and laugh it off. Likes been mentioned, personal responsibility for the things we do really comes into play.

Sorry for what you went through though kitten, that seems like a totally different scenario to me.

"voluntary" is in the eyes of the beholder,if everyone participated,and she did not;
it could easily have a detrimental effect on her job. In addition, many workplace activites are only voluntary in theory; not in fact.
Obviously the particulars of a given circumstance,need be revealed prior to passing judgment. Lastly,whatever kinks a persone has in private life

Sorry but any organization in today's world (damn, especially in California) should know how open they are to lawsuit by allowing such an exercise to occur.  Whether or not she volunteered - did she know she would get spanked in advance?  And if she did NOT volunteer, then she would have been singled out and left out as a result, therefore being the victim of a hostile environment (Hostile Work Envorinment in California is not limited to outward hostilities).  Even a fellow employee passing by and witnessing the activity could have felt uncomfortable enough to charge a complaint.

Plain and simple, whether reasonable or not, no company in its right mind would sponsor such behavior.  Unless of course they have a whole bunch of money to spare and want to give it away in a lawsuit. You could have 500 people all thinking it is fun and innocent behavior (and it very well may be).  All it takes is one person to feel really uncomfortable and voila - party's over.

Sometimes I think western culture has more victims than draught ridden sub-Saharan Africa. There are too many people wanting to see a pay day and bring sex and race laws into disrepute.

Years ago I used to work in the Social Services and had to listen to social workers constantly bitching as to how victimised and abused THEY were! They completely forgot what they were there for. All part of the smash and grab culture.

Dangle a pay day and 99 out of the 100 will be fake claimants.

I work in NC for a company that is based in CA. The company started years ago in someone's basement, and has turned into an online success.  However, because the company started like "family" there were some things they used to do as "moral builders" that started as silly things which helped the morale of the team at the time, but we wouldn't consider doing now that we have grown to almost 200 employees.  
 
Also, being physical [IMHO] helps build a team because millions of years of evolution has hardwired it into us (especially the guys).
 
Without the history of how this spanking got started, there is no way to judge the action.  And until someone says stop, you don't know how they feel. 
 
I wonder how many times she got to spank someone/ throw a pie/ verbally abuse someone - but then it wasn't so much fun when it was her turn?

It might have and it might not have. If it was "voluntary" only in theory and she felt repercussions because she did take part in the activities, then she would have had a better reason to sue and have saved herself this embarassment.

I'm on the side of the company. So, they hit them on the ass with a competitors sign if they performed poorly. That's funny, (basicly symbolism for getting your ass stomped in sales) personally, I wish people would put on their applications that they were uptight and humorless. It would be a lot better for the rest of the people that get why it's funny. And using the word spanked to illicit a response is pathetic. They whacked them with a sign of a competing agency, whatever, some people really need to stop looking for excuses to get pissed off. I hope this woman loses the and never finds another job again.

This is why corporations and business are so sterile and bland. This why people hate working at corporations, because fun has been reduced to whacky tie day. LOL. But eating baby food if you perform poorly, is abuse. Whatever, it's funny. The woman needs some meds. ASAP.
