I've not paid much attention to this while situation, however the New York Times reported the following:

Deputy Commissioner Paul J. Browne ... said that the victim’s “two-year-old son was asleep in an adjoining bedroom.”

The steps that led to his father’s arrest began when he and his brother, Andrew, confronted their father over his plans to distribute hundreds of millions of dollars in bonuses to employees months ahead of schedule.

That led to a private conversation on Dec. 10, 2008, in which Bernard Madoff told his sons that their entire lives — all the wealth and success the family seemed to possess — were based on a lie. His apparently lucrative money-management business was nothing but an immense Ponzi scheme, and it was crumbling under the relentless pressures of the financial crisis of late 2008.

Mark and his brother immediately consulted a lawyer and were advised they had to report their father’s confession to law enforcement. They did so, and the following morning their father was arrested at his Manhattan penthouse.

But charges have not been filed against any of the immediate family members, and their lawyer has said publicly that neither Mark nor his brother has ever been notified by prosecutors that they were the subjects of a criminal investigation.

I did not know the son faced charges. Well Gee- many even on this board had a brush with the law- and we are all just fine.

And SHAME on the guy for suiciding having a 2 year old and in front of him! SHAME SHAME SHAME!

Even still- I am sure this hurts the parents- the parent is supposed to die first not the kids. It is an un-natural order of things. It will hurt Mr Madoff more then any court can.

You're right, Treasure. He has not been charged with criminal acts. He is being sued civilly to recover money, though - I confused the two. Although the Times article states that Mark Madoff was an executive and/or a board member in the firm - how can you be one and be completely unaware that there is no actual investing going on?

Have you ever dealt much with Boards of Directors? In my experience, many have very little hand in the day to day operations of an entity. They receive reports, make decisions based on those reports, but do no actual work within the entity.

I've no idea about the Board in the Madoff situation... I'm just saying how it can be possible.

From all public reports I saw the sons behaved legally and with some dignity.
I personally think the honorable thing to do would be to return their share of the money......
In any case we should not assume we know all the reasons he took his life.
I think he and his family deserve something other than contempt.

Losing a kid has got to be the worst thing any parent can go through, even if the parent is a crook. I hope the parents find peace one day.

But, after reading that the young Madoff killed him self while his son slept in the next room, making it a possibility that that child could have found his dad swinging, I hope there is a special place in hell for the selfish bastard.

People never cease to amaze me with their utter stupidity.

He seems to have taken some measures to prevent his son from finding him, and may have taken extensive measures... People who commit suicide may not be thinking too clearly.....

I've sucked on my own gun barrel. I feel badly for the guy. Unless it can be proven he was complicit in the crimes, I'm not going to pile on.

Once again, he reported the crime.....
A crime there is no evidence he aided in any way...
He killed himself, possibly for unrelated reasons, but quite possibly just for the shame of what his father did.

It is possible he was killed. He obviously knows too much. I guess many important people are involved with Madoff scam including high ranking government officials. The multiple lawsuits threaten to expose the crooks.
