No surprise here. Appointed by Bush. This was reported last week, before the judge ruled.

willbeurdaddy -> RE: Judge rejects key part of Obama healthcare law (12/13/2010 10:44:39 AM)

No surprise there. The individual mandate is so clearly unconstitutional there was no other outcome possible.

hlen5 -> RE: Judge rejects key part of Obama healthcare law (12/13/2010 10:52:23 AM)

Yay!!

I agree we need a healthcare overhual. Why do people in the US pay more and recieve less healthcare?

The struck down provision seemed to me a loophole for any employer to get rid of their healthcare plans. If your employer doesn't provide it you must buy it? What a crock.

On the other hand, we do the same thing with car insurance (mandated individual insurance).

Actually I got sticker shock- I got the bills - for the past few month- what was changed and what was re-embursed- and all of the numbers are obscene.   the past 10 years have been brutal.

Well any one with any commmon sense knew it was unconstitutional to require people to buy something they may not want or need. However, since it was a federal judge I halfway expected him to rule in favor of the federal government. The fact that he didn't, makes it even more apparent than it was unconstitutional in the first place.

mnottertail -> RE: Judge rejects key part of Obama healthcare law (12/13/2010 11:51:34 AM)

Was there ever a question of this bill not going to SCOTUS once it became law?

Hey guys, it is a conservative activist judge, hard at work. Legislating from the bench. But since its a conservative, appointed under a Republican, its 'ok', right?

Since what would Republicans gain from the Health Care Act being declared unconstitutional? This decision was politically motivated, pure and simple.

Liberal activist judge: a judge who actively looks for reasons and justifications to enact his ideology by reading into laws and the Constitution things that are not there.  Supports "rule by law".

Conservative activist judge: what a lefty calls a judge who actively looks for exactly what is written in the law and Constitution and then rules based on those things.  Supports "rule of law".

Ok.  I'll take a "conservative activist judge" any day of the week, thank you.

Firm

You can not pay car insurance, you just can't drive on public roads.

truckinslave -> RE: Judge rejects key part of Obama healthcare law (12/13/2010 1:39:10 PM)

I think it comes down to Kennedy; and I think it's toast.
Cantor called for a direct appeal to SCOTUS, and I agree. If we can just get them to toss this thing we won't have to kill it piecemeal, or turn 2012 into a referendum on it (new low approval rating today, btw).

I am not a conservative in the political sense. How is it constitutional to make a citizen spend their own money on something whether they want it or not?

We NEED helathcare reform. That bit only benefits insurance companies. We need a better healthcare overhaul than this mess.

No surprise there. The individual mandate is so clearly unconstitutional there was no other outcome possible.

Surprisingly most of the judges that have reviewed the law so far have found it perfectly Constitutional. Only 1, found by rather aggressive judge shopping by the VA AG, has found otherwise.

tazzygirl -> RE: Judge rejects key part of Obama healthcare law (12/13/2010 3:11:40 PM)

There is another that will be ruling soon. Its said that judge will also rule it unconstitutional.

KenDckey -> RE: Judge rejects key part of Obama healthcare law (12/13/2010 3:14:49 PM)

Anyone have any idea how many lawsuits are out there and if there are any plans to consolidate them?

When was the last time you did any business without needing an ID?

Charles6682 -> RE: Judge rejects key part of Obama healthcare law (12/13/2010 3:48:57 PM)

I do agree that the mandate to buy health insurance should go.The Federal Government is going too far into people live's on this one. However,I still think alot of the other part's in Obamacare should stay.Like how Insurance companies can not deny you if you have a pre-exsisting condition. The part that prevents sick children from being denied is already in effect.Do you want to repeal that part too?So when little Timmy gets sick,he wont get health insurance because you think this was a bad bill?Would you feel happy then?
