JACKSON, Miss. – For 16 years, sisters Jamie and Gladys Scott have shared a life behind bars for their part in an $11 armed robbery. To share freedom, they must also share a kidney.
Mississippi Gov. Haley Barbour suspended the sisters' life sentences on Wednesday, but 36-year-old Gladys Scott's release is contingent on her giving a kidney to Jamie, her 38-year-old sister, who requires daily dialysis.

Okay, i don't know how i feel about this condition - it makes me tilt my head suspiciously with a huh concept as i believe its illegal to sell or use body parts as an exchange concept in this country and to me, this almost feels like the government is selling/exchanging this woman's freedom to her -- the cost -- a kidney. 

So i thought to post this to see how other people are seeing it.  I am focusing on the the condition for one of them to be released, rather than whether or not they should be released.

I think that it is horrible to release them for that reason.

yes she did, but the government is now conditioning her release based on her following through on that.  I don't see how her volunteering her kidney is relevant.  The government has now dangled the proverbial carrot before her to maintain her agreement or she spends the rest of her life in jail.

If they went through with the transplant exchange and THEN given her release, i wouldn't be having a struggle, its the fact that they are actually conditioning her release on her giving up her body part that i am struggling with.  To me her volunteering is not relevant as it doesn't mean much if she doesn't go through with it.  Now she has the carrot of freedom dangling to keep her going through -- how do we really know she is continuing because of volunteering or because she wants her freedom.

Quite. When officials make such demands, they are guilty of extortion. They should themselves be convicted to do jail time.

It's financial.  Right now, Jamie Scott is costing the state a lot of money due to the dialysis.  When released, she'll have to continue dialysis, likely on the state's dime.  Since she got the kidney disease while in jail, eating state supplied food, she could hold the state liable for the disease should she want to sue.  So if she gets a kidney, and her sister's is likely the best match she could get, she'll be off state-paid treatment.

From what I'm catching in the article, this was something that they were willing to do anyway.  If the release is part of the deal, the medical costs don't fall to the prison system.  If she's kept incarcerated until the procedure is complete, the state has to pay for the donor's care for her being an inmate.  Releasing her prior to becoming a kidney donor will save the expense.  Not sure if it's being picked up by private funds at that point, as the article doesn't say.

yeah i get that logically, but it just seems like they are dangling a carrot and if she backs out, which she could want too, she will be sent back to prison.  I do get the financial concept, its just the condition i have issues with.  Either release her or don't, don't place a condition on it of her giving up a body part.

I do get releasing the sister with the issues because of the money. 

As i said, that's why i posted it, i guess i just want to see if anyone else is focusing on the condition as i am or if i am seeing it differently.

Probably not although it likely won't come out of the prison budget at that point. The sister with kidney failure likely qualifies for both medicare and medicaid (people I get dialysis with get both and I don't only because I have enough money in the bank to not qualify for medicaid). Medicare will pay for the transplant if the sister isn't in prison.

I'm staying out of the shoulds or should nots of it cause I'm too tired. However, I do want to add to the discussion that there is a precedent of a sort for this.

In this case, one convict volunteered himself for malaria testing - something I'm sure contributed to the fact that he was released later. Good behavior and all that.

Renal failure is the one disease that doesnt get rubber stamped "denied" by disability. The state will continue to pay regardless. The difference is paying for dialysis, or the cost of transplant and rejection meds.

Regardless of whether the donor sister volunteered the organ or not the governor shouldn't involved the organ donation in any way with the release of these criminals.
