It's obviously not forbidden by the Wisconsin State Constitution, ergo it is constitutional. As Rich points out, it's a mechanism that for whatever reason or reasons is built into the Constitution, and whether or not this was the intended reason is immaterial. It's allowed, therefore it's legitimate. However extreme it may seem.

Didnt think anyone would answer that directly. Fact is, the state is in a budget shortfall because of bills and spending that Walker enacted himself.

One Wisconsin Now, the progressive watchdog group that has provided the closest monitoring of Walker’s budgetary gamesmanship, explains:

“Since his inauguration in early January, Walker has approved $140 million in new special-interest spending that includes:

“• $25 million for an economic development fund for job creation that still has $73 million due to a lack of job creation. Walker is creating a $25 million hole which will not create or retain jobs.

“• $48 million for private health savings accounts, which primarily benefit the wealthy. A study from the federal Governmental Accountability Office showed the average adjusted gross income of HSA participants was $139,000 and nearly half of HSA participants reported withdrawing nothing from their HSA, evidence that it is serving as a tax shelter for wealthy participants.

“• $67 million for a tax shift plan, so ill-conceived that at best the benefit provided to ‘job creators’ would be less than a dollar a day per new job, and may be as little as 30 cents a day.”

To the extent that there is an imbalance -- Walker claims there is a $137 million deficit -- it is not because of a drop in revenues or increases in the cost of state employee contracts, benefits or pensions. It is because Walker and his allies pushed through $140 million in new spending for special-interest groups in January. If the Legislature were simply to rescind Walker’s new spending schemes -- or delay their implementation until they are offset by fresh revenues -- the “crisis” would not exist.

The Fiscal Bureau memo -- which readers can access at http://legis.wisconsin.gov/lfb/Misc/2011_01_31Vos&Darling.pdf -- makes it clear that Walker did not inherit a budget that required a repair bill.

The facts are not debatable.

After skimming over the whole thread, a thought comes to me....I am not all that sure that the legislature can unilaterally revoke an existing contract, I'm pretty sure it would end up in court, and up here I expect the union would win.

You have got to be kidding me.

I will bet that the Wisconsin State Constitution does not have an article forbidding its cities receiving an H-bomb. Or bringing in its own Typhoid Mary.

If the Governor is allowed to have state troopers gather and return these senators, then it is apparent that they are doing something illegal. The fact that they are not to be impeded in their efforts to arrive to the legislature building means that by fleeing their duties, they are guilty of malfeasance.

If they are not showing up for work, yet are still receiving the money, then they are stealing. It does not get simpler than that.

You might compare the average teachers salary (in Wis, or generally) to the average earnings of other citizens with four year degrees.

Then you have no idea what a person with a good degree can make. As I said above I have a BS in math, required for HS math teachers, and was making just over 100k/year until I got sick with 10 weeks of vacation a year. And my vacation was when I wanted not designated by someone else.

The savings from that, compared to the billions the state needs, wouldn't make a pimple on my ass. Much less yours.

Maybe the union prez should run for governor, if the rank and file will agree to make up the pay cut he'd suffer if he won.
