Abstract Building on themes embodied in his epochal 1964 Yale Law Journal article, The New Property, Charles Reich wrote The Individual Sector as a response to what he sees as an increasingly narrowly defined realm of individual liberty. Using an analogy to the natural environment, the author sees the habitat of the individual as seriously endangered and the functions of the individual as severely impaired. This Article's answer is to provide for a constitutionally protected individual sector that guarantees some measure of affirmative power for the individual as well as freedom from the invasive power of authority. In his Article, the author examines decisions from the Supreme Court's 1989-90 Term that weigh individual interests against those of the state. Considering the individual's position both "inside" and "outside" the organized sectors of society, he describes the Unbalanced Constitution that results from the Supreme Court's permissive standard of deference toward bureaucratic action in comparison with its narrower reading of individual rights. The author next discusses the government's obligation to provide minimum economic support to individuals and argues that the guarantee of a sustaining economic habitat is necessary for effective individual participation in popular sovereignty. Finally, Reich advocates the reification of the individual's unique contribution to the community and proposes that the field of "Law and Individual Liberty" be considered an area of further academic pursuit.

What I like it what is has to say about courts not relying about intentions but on the actual words of an act. The concept being that once an act is law, intentions are codified in the...words of the act.
