This guy will rape again. Some little girls blood will be on the hands of who ever let him out.
Yes let us disregard that the Judge merely followed the letter of the law and move right to the point of demonizing him.
Typical neo-con,mean spirited knee jerk reaction. You are a credit to your kind.
No,I apologise for that last...no need to paint every last neo-con with your level of disconnection with reality....as I said in the last...you are one of a kind.

I love how Servant doesn't apologize for fucking shit.

What a douchehole. The nerve of you fuckers to say your stupid shit, be corrected and then act like nothing happened.

asshole.

Hey go easy on him! He made a penetrating deep professional analysis based on the wealth of data in the OP. Why do you assume he's stereotyping or demonising? Just because he jumps to wild outlandish conclusions without any evidence to support them doesn't entitle you to do the same! [:D]

Apart from that he's ..... one of a kind! [:D]

Wow servant...any opportunity at all to take a cheap partisan shot. You are one of a kind.
Let me ask you a question ...are you suggesting that a good "conservative" judge, despite the constraints of the law...would have found some way to lock the bastard up...legality be dammed?
Is that the type of judge you want on the bench when you or one of yours is in jeopardy ?

I'm guessing that he is not a conservative judge.. Elections mean things..

Reading not your strong point ?

Under the Law, the judges hands are tied to what the law states. I dont know why you find that hard to figure.

well in criminal their hands are "more" tied but even in criminal they can legislate from the bench

jlf1961 -> RE: This is criminal justice? (4/7/2011 9:18:33 PM)

The question remains, how can the psychologist who evaluated him say he is not a danger to the public, he is a repeat offender and convicted once already.

Real0ne -> RE: This is criminal justice? (4/7/2011 9:30:41 PM)

define danger

Aneirin -> RE: This is criminal justice? (4/7/2011 9:33:28 PM)

The psychologist was giving his evaluation for the time he evaluated the person, which is not to say the person might change, but at the time of the evaluation the psychologist believed he wouldn't and that based upon the fact that although history is an indicator, it is by no means an absolute. As far as I can see, the psych was doing his job with professionalism based upon the tenants of his profession, not the needs of others.

I suppose it is a bit like a vehicle annual safety check, it is only valid for the time it is evaluated, what can happen after that time is another matter.

Simple to me. The guy has some sort of pull. If he rapes again there will be hell to pay, but so far he is out. If you plan to be bad in Utah, just be a member of the Morman church and get this guy's lawyer's phone number.

Many people get off easy on all kinds of nasty shit, and others rot for decades for bullshit. Are we so delusional that we are going to sit here and pretend we don't know why ?

The judge is doing his duty, under the law, distasteful as it may be. Now we hope the next doctor has a damn clue.

Yes. If there's anything to be learnt from this tale, that is the question to ask, it seems to me. That is the evidence that forced the Judge's hand.

Personally I wouldn't like to be the psychologist concerned.

Real0ne -> RE: This is criminal justice? (4/7/2011 10:08:55 PM)

I am still waiting for someone here to define danger?

I dont mean tossing every dictionary me on the web I mean how did that doctor use the word danger since his determination hinges on that word?

If people think that is not important then ask yourselves why clinton said "it depends on what *IS* is"

"Considering that this individual is already known to be a repeat offender, how can anyone say he is not a danger to the public?"

It might not seem right, but the court isnt releasing him on if he is or isnt a danger to the public. Seems to me that the courts hands are tied to what the legislation actually states.

Actually, the doctors who evaluated this individual reported to the court that he is "Not competent to stand trials" and "is no danger to the public."

Again, with him being a repeat offender, how can anyone say he is not a danger to the public, or are females under the age of 18 not members of the public?

Maybe they should pass a new law. If you are not competent to stand trial, then you are not competent to live unsupervised.

Termyn8or -> RE: This is criminal justice? (4/8/2011 5:05:42 AM)

They already have something like that in many states, it's called guilty but insane. But then from what I've heard of Utah it wouldn't work very well there. There would be nobody roaming the streets and paying taxes.

LafayetteLady -> RE: This is criminal justice? (4/8/2011 7:26:35 AM)

It would have been nice if they were more specific about his "cognitive disorder." Cognitive disorder can mean anything from depression to Alziemer's or schizophrenia. Theoretically, they are saying he can't remember what happened during the crimes in order to participate in his defense. The question is did this cognitive disorder exist at the time of the alleged crime? In my opinion, if it didn't, his current "disability" should be irrelevant. Think of it like this: Ronald Regan didn't have Alziemer's when he was president. Therefore, any decisions he made as president could not be blamed on his cognitive disorder. However, such a current problem could affect what punishment was given for the crime. For instance, someone who was a quadrepelegic on a ventilator would not be placed in a high security prison and due to their condition could not likely pose any physical danger to others.

Now I realize that is not likely the case with Johnson, but I would like to know more about his condition and when it developed. Further troubling is that he already was a registered sex offender. It would seem, he already served his time for that offense. Like it or not, our system rarely locks sex offenders up for life. You don't have to like or even agree with that, but it is what it is.

So maybe the question everyone should be asking is why a woman with a child would marry a convicted sex offender and have no idea what was going on under her nose for 5 years? I find her at least partially responsible for the abuse of her daughter and niece. Sound harsh? Damn straight. In almost all cases where a parent is molesting a child, the other parent refused to see the signs. Sorry, I find that almost as bad as the molester.

It will be interesting to see how this plays out, if addtional information becomes available.

That sounds realistic to me. It's a big ask to believe that it isn't noticed isn't it?

That's a tragedy in itself too. There's just nothing connected with this kind of thing that offers any hope is there?

Whats your point here...I did in fact apologize in my own post for lumping all neo-cons in the same basket...and in both posts went to great lengths to state servant was..."one of a kind"...a description that might aptly be applied to you too.Of course in your case it is a different sort of "kind" that you are "one of"
When you figure what your point was,and lets hope it has nothing to do with the Queen owning America, come back and make it !

Record of a child rape conviction.

Currently accused of 21 counts of sexual assault with two more girls, namely his step-daughter and her cousin.

And you want a definition of danger?
