This letter is in reference to the inspection of your finished pharmaceutical manufacturing plant, Forest Pharmaceuticals, Inc., located at 5000 Brotherton Road, Cincinnati, OH 45209, conducted on January 28 - February 20, 2003, and to your firm?s continued marketing of Levothroid? (levothyroxine sodium tablets, USP) without an approved application.

So CEOs are expected to be mind readers? Any convictions on this basis will never hold up in higher court unless it can be proven the CEO was negligent in not knowing.

The bailout was anti-capitalism, not capitalism. And there arent billions "missing" at the Pentagon. Sloppy accounting isn't the same as real money gone. And of course that has nothing to do with capitalism even if there were.

Exactly...not to be mind readers. There are two words in your phrase, the first is DUE.

Typically, the corporate culture has it that I am supposed to make $millions even 10's of $millions a year because I am a captain of industry. [sic] I am that heroic pro that is going to make the stock holders (and myself) a whole lot richer. Oh but...

...no I am not responsible if my products kills you or my workers. I am not responsible if my drugs don't work or fuck you up. I am not responsible if my oil platform blows up and kills your husband or your son. I am not responsible if my coal mine falls in and kills them either but...

...I am worth and because I add so much to society [sic] all of those $100's of million$ I'll make over my lifetime of zero liability.

It is the very essence of American capitalism. You can't say capitalism is the best, makes everybody richer, then when we see that it does nothing like it and the outright fraud and continue to see violations of law and 'civil settlements (cos-of-doing-business) then try to tell me...that's NOT capitalism. It most certainly IS capitalism.

Our so-called 'capitalists' on wall street gambled with other people's money...to MAKE HUGE MONEY to enrich themselves at ZERO benefit to society and in fact having financially enslaved society, blew it out their ass and WE bailed their asses out. It's called socialism for the rich. Capitalism for the poor. 

You see crime in the ghetto and you call them criminals. I see crime on wall street I get to call them capitalists, criminals just like they were yesterday and will be tomorrow.

Sago mining disasters and their ilk, Exxon Valdez, BP, Love Canal, Johns Mansville, AllState Insurance,  stuff like that.  Nothing you would bother to know about or read up on.

This whole post is about how with dusty old laws I never knew for sure even existed, finally empowering DOJ as having now established liability upon management, can go after corporate crime. (one reason every founding father save Hamilton...was against the corp.)

The original idea behind the corporation was to privately profit while having no private liability. To the extent govt. can now go after management criminally for bad management...is a sea change in corporate capitalism.

There has NEVER been protection against criminal liability or negligence. The corporate veil is and always has been strictly for ASSETS.

I am going to start up a company. Promise people the world and collect millions. Take credit cards and everything. By the time anything gets to court I will be off with millions in Dubai, and I will just do it again somewhere else. No problem as long as I can get a corprorate "shell".

Fucking know nothing, even the best. Incorporate that which requiures a paper trail, and nothing else, like those other ffve little enterprises. Geez, yagotta tell some people everything.

And if you make it halfway, privatize the gain and socialize the loss. It works.
