Thanks for your replys. I have been testing the lawyer out and her also. I told the lawyer that she is entitled to it and she would have to give it to Me. So far I haven't heard back from him. Thanks especially to crazyml.

Again....have you talked to both of them face to face?

Steven, if the slave gave this guy POA, or has given the lawyer any type of written permission to deal directly with this guy with regard to this fact, or she has directed him to put it in a trust -- it is NOT illegal and the lawyer as long as he is covering his ass with written permission from the slave, he won't be disbarred.  It's not clear what the slave knows or doesn't know.  With regard to the wishes laid out in the will, it's not clear what the will says.  For tax purposes, this guy needs to be careful also.

There isn't enough information to decipher what the will said or what legalities are in place for the money or what the whole think really is.  When in doubt of what you should do, at the very least get your own attorney and/or accountant if its involving a lot of money.

I haven't read anything beyond the OP. If its a scam, then live and learn.  However, the attorney fees ae usually paid by the estate.  I didn't see where they were asking him to pay attorney fees.  But as i said, i didn't read beyond the OP.

It's a common scam. I get about 2 or 3 of these a day in my junk email that I use for contests, games, etc....

If its a trust or they are setting up a trust, then as long as they have the agreement of the slave, there is nothing illegal about this.

Strictly speaking, most trusts don't require the agreement of the beneficiary, that being somewhat the point of setting one up in the first place.

Intersex is a more accurate word, FYI. Transgender implies that one is, or has been, transitioning. Hermaphrodite. Is also technically correct, but at least in the US, has a negative connotation.

Duly noted, and thanks for the pointer.

That's the second time in a week I've had to be corrected. Who'd have known the polite term for oompaloompa is "dwarf"!

crazyml, most trusts are already set up by the deceased and are incorporated into the will.  A trustee is usually also appointed at that time.  So in THAT scenerio you are correct, the trustee would be the one to determine what to do with the money.

However, this seems to be a situation wherein the woman is to receive the money directly.  Last i checked, a lawyer cannot determine what to do with money directly given to a beneficiary of a will.  Therefore, yes, they would need her permission with regard to dealing with the money, unless and only if the will stated something different.

Perhaps your practicing of law is different.

This is why i also recommended the guy get his own attorney, who would then be able to get the specifics of this matter.  All the rest of us are doing is speculating, and i am not about to sit here and name every if this, then that concept of legalities.

...the whole thing is a scam.  The idiot is being asked to fork over several hundred to several thousand as a lawyer's fee, in order to get the fortune given to him.  There is no slave, there is no inheritance, there is no lawyer.  There is just a scammer and a gullible man.

DING... DING... DING... DING... WINNER!!!

[Ed to remove O/T bandying of words about trusts]

Personally I think your advice to the OP is rather pointless. It's a scam, the only sensible advice that can possibly be given is "walk away".

I suppose, for shits and giggles, the OP might want to make some casual enquiries, but the likelihood that this is actually genuine seems so impossibly remote to me that "hiring a lawyer" would be a fruitless and embarrassing exercise.

Bursts out laughing, umm crazyml,

It's not that deep for me.  It's an anonymous public message board.  Seriously, it's called opinions crazyml.  Get over it.

angel

PS, The fact the guy is on a public message board ASKING people about this, can lead some people to believe he is naive enough to go forward with it, and in the end, if he is, he would be STUPID not to have an attorney.  That way it may save his butt from being taken by scamers.

But yeah, it's pointless to mention this.   Maybe he may listen to you, i hope he does.  However, just the fact he is on here asking, means i am going to tell him to get an attorney because to me, he is naive enough not to believe its a scam.

this doesn't even begin to make sense.

are either the slave or lawyer anyone the OP is even personally familiar with? if not, why would a random slave from across the innertubez contact some faraway "Master" so that a lawyer could give away her bajillion dollar inheritance (which is against the wishes of her dead Mistress)? is that even ethical/possible?

frankly, i would worry about anyone who'd be sucked in by something like this. if he doesn't believe that it's a scam by now, then hiring a lawyer is only one in a long list of things he needs to do...

yikes.
