Another thing that people need to consider when purchasing a house, especially if you are a do it yourselfer like I am. Always know what the local building codes are.

Where I live now, I could literally build another house on the property and not have to comply with any codes except those set by the state. In Cedar Rapids, where I moved from, we were not even supposed to replace the porch steps or build a garden fence without getting a permit and showing blue prints (money for the city) and then having it inspected to make sure it passed code.

Here I don't even think about it. When we built the garage, which is nearly as big and complex as the house, we did not have to get a permit or have it inspected.

I own property in an HOA, several years ago the grumpy jerk across from me (with a creek in between our properties) started on me about my trees, claiming they were dangerous. I told him to f off, basically. Then he got himself elected to the Board of the HOA. He had a lawyer (which just happened to be the same lawyer for the HOA) to send me a threatening letter. I sent his lawyer a letter telling him to f off and that he didnt have a case. Then shortly after that, I happened to show up one day to find tree cutters just setting up to chop down my trees. I called the police and then I called the manager of the HOA and read him the riot act about this guy who was on the Board and trespassing and illegally cutting down my trees. I think the jerk sold his property & moved not too long after that.

The previous owners gave the jerk permission to cut the trees but the dumb f**ker sat on his hands and didnt cut them when he had the chance.

What really p*ssed me off was the HOA lawyer, imo that was conflict of interest to send me a threatening letter on non-HOA business (since imo as an HOA member the f*cker worked for me).

Some of the worst ones here in FL are the Condo Associations.  Old retired fucks with nothing to do get in charge and make everyone miserable.  This seems to happen a lot in smaller condos.  Many of the worst offenders are from New York and New Jersey. 

The beaches there in Cocoa Beach are no dogs allowed.  Some person who lived in the area would occasionally walk there do on that stretch of beach.  The "asshole" who was the President of the Association for that Condo would sit in the sea grass for hours with a pair of binoculars.  As soon as he saw the dog walking on the beach he would call the cops.  Funny part is by the time the cops got there the dog was always gone.  He would sit out there for hours at a time, days on end with those binoculars searching for a dog.

You can just imagine the kind of crap he tried to inflict on the other owners.

In reference to assessments, the Finance Committee, along with the Building Committee, the Accountant and the Management Company, present to the board proposals. Those proposals are discussed at the general meeting and ruled on, unless of course emergency exists, in that case the board votes one way or the other and keep in mind board meets are required by law to have minutes and minutes are construed as Association Documents so are availed to all residents upon request.

Never lose sight of the fact the Association is owned by the owners, if there are things in the Documents Bylaws Rules or Regulations the owners collectively by 80 % or more want changed the Association Attorneys can re write the Documents at any time providing the changes are not in violation of Codes Restrictions or Sunshine or Condominium or HOA Laws.
I have built many Condominiums and HOA Housings Developments throughout Florida and I am always amazed when I hear owners complaining about the Board. Its their Association, they are responsible, the Board is simply elected residents who are capable of recall acting on their fellow residents behalf and most would much rather be fishing.



I sold property in FL in the mid 90's.  It's VERY different in different states.  During that time, I ran into Condo Associations and HOA's that worked well to maximize values and some that hurt values. (Actually explained to one elderly and venal president that "something that cannot be sold basically has no value" when she was repeatedly trying to block sales in 'her' complex.)
I also sold homes in coral Gables, FL which was dubbed "The City Anal Rententive" by a local newspaper.  You couldn't even paint a bathroom without having the color approved and getting a permit.  For that reason, a lot of folks would look look at an info sheet and say "Oh hell no, not there" like it was overtown or something.
If people don't want to buy a home in a certain area, it hurts property values in that area.

The company I now own has been developing in TN for over 40 years.  The HOA's we left behind all worked well..............initially.  The smaller ones can sometimes devolve into a clique driven monarchy.

I like that my mother's Lake Association and relative Beach Association have regs to keep gas motors out of the water and off the beach. (Smells better; quieter.)

I would not buy into a place that regulates what I could plant or what colors I could paint.

Caveat emptor.

When I first moved to Florida I had a nice sport truck that the HOA wouldn't allow so I had to rent a car and put my truck and motorcycle in storage.

In a way I can understand banning motorcycles because of the noise, but then they let the old folks drive around the place in ancient pieces of junk with mufflers dragging on the pavement.

In another place I lived in I was allowed to keep my truck there but it had to be kept in the garage.  I couldn't leave it in the driveway for even a short amount of time or someone would complain.  The motorcycle I could only take out the back exit, and even that wasn't supposed to be allowed there but I was a neighbor of the HOA president.
