"Amazon said it would seek a ballot initiative to strike down a new law in California that forces online retailers to collect sales tax, the New York Times reported. The earliest the initiative could be put to voters is February 2012.

Amazon recently cut off relations with its affiliates in California in order to avoid complying with the requirement, since the law affects only businesses with a physical presence in California. Before it was put into effect on July 1, those affiliates didn't count as a presence; now they do.

However, California officials say that Amazon's actions don't negate its tax responsibility from this year, which is estimated at $83 million. Amazon's next tax payment is due at the end of the quarter, which ends Sept. 30. The State of California estimates that it loses about $1.2 billion a year in unpaid sales taxes, partly due to online e-tailers like Amazon.

Whether or not Amazon has to pay depends on your definition of "physical presence." Putting aside afflilates, Amazon has subsidiaries in the state, says the Times—specifically, an office in Cupertino that designs the line of Kindle e-readers, and a Studio City office that does online advertising. Should those count?

Amazon thinks it's the wrong question, supporting a simplified sales-tax law that would be applied federally, across the country. That would require the cooperation of both Washington lawmakers and state governments. The company's sales-tax issues aren't limited to California; Amazon also cut off its affiliates in Illinois when that state also enacted a similar sales-tax law earlier this year, and it's shuttering a warehous in Texas over the issue.

For the California law, Amazon needs to get 505,000 signatures to qualify for a referendum, which would be put to voters during the next statewide election, due in February"




Walmart and some othet big-box stores don`t want tax-free online sales said they plan to fight Amazon with an open checkbook.

Should be interesting.

They will not get my support for it... we need the revenue in this state desperately. I may just boycott Amazon for this...

I didnt know they had a sales tax out there.

Sounds pretty oppressive.    Why would I pay tax when I have to pay shipping?

Like that's what CA and their businesses need right now,  for Amazon to cut off relations with its affiliates. Along with all the other businesses moving out of CA it's just more straws for the camels back.  I guess they better get that 83 mil cause their gunna lose more of that desperately needed income in the long term.  Isn't it funny how people jump through hoops to get out of paying taxes ?

My point is that taxes go on whether you buy local or not.... you cannot ditch the tax by buying online

Responsible citizens and businesses need not like taxation...all they need do is acknowledge the necessity of taxation.It is a simple thing really....gov provides services,security and such....and these things cost money....hence taxes.
One would think these things did not need explaining [8|]

I pay sales tax, and I expect others to pay sales tax that live here. People seem to always duck out paying their share.

They lost shit. They have no right to that money because it is outside their jurisdiction. In this case the definition of loss is "something we aren't taking yet".

Ohio want people to tattle on themselves and send in the sales tax on their out of state online purchases. Wanna take a guess at the level of compliance ?

And needing the money is not an excuse for taking it.

Last I looked I live in California, meaning my purchases are in California's jurisdiction because I received the goods while living in California. Tax dodgers suck.

Indeed. If I were Amazon I wouldn't bother the People with this. I would just announce that all operations in California will be shut down. You don't use a straw to break a camel's back, you drop a brick shithouse on the MF.

This is a publicity stunt, which they can afford. But the fact is, they can simply move out and that will cost alot more revenue than sales tax. Californians are a weird lot, they might just vote against the repeal, not understanding the eventual outcome.

EXACTLY!

If it is NOT bought in California it should not be subject to sales tax solely because the computer's enter button is in the Golden State,

If there is any sales tax at all, I would think the state in which the product is located, would have a better claim to it.

It wasn't dodging for the last couple hundred years, why now ? Because they found another pocket to pick. They already tax the air, what's next ? Plus the fact that California was one of the few states that got back more from the federal government than Californians paid in. It was OK when you all picked our pocket.

Amazon will eventually just move, and as state after state decides to pick more pockets, they will just move out of the country. Happy now ?

Wrong... I do not know where you get your info, but this isn't true... chances are if you live in a red state you get back more than you paid in, California is paying for you.

I can tell you, as a citizen that pays the way of so many red staters, they truly get on my last nerve when they belly ache about how high their taxes are when they are not paying their fair share... truly a bunch of free loaders who expect blue states to pick up their debts

Well I'm glad that changed. That's not the way it was for decades. Notice I did use past tense thus :

That's because I know how it was, but I didn't know how it is. Thanks for the good news. Oh, and enjoy the infrastructure.

Must be nice to be so affluent as to come out in favor of more taxes. It must be quite blissful to believe that the money will be well spent. I guess I'll learn Spanish and claim to be an illegal so I can get on the welfare rolls and then I can smoke some of that good California shit and join in the big party.
