Came across this today, thought some might be interested: http://www.dailymail.co.uk/news/article-2038543/Lawyer-Alisha-Smith-suspended-moonlighting-dominatrix-S-M-events.html Seems to be more an argument over the fact she was earning more than $1000 than the activities involved, which is refreshing if true - the papers going for the usual scandalised approach

If that's why yeah it's refreshing. I am annoyed that they needlessly outted her fellow Domme who might not be out as kinky by giving out her real name.

It does sound like she was suspended for violating an office policy. I can't imagine how being a pro domme would violate any rule of ethics, unless a client was involved. Since her client wad the State, that couldn't happen. Still, she should have been familiar with the rule. Can't believe she was only making 80k prosecuting such high profile cases. I can't imagine her being disbarred for this, so she will just go into private practice, and make a ton of money. Then she won't have to moonlight.

Ethics, probably not but they could argue that it gives the AG's office a bad image.

It does make the AG's office look bad. It is obviously a conflict to have outside employment, at least if it hasn't been approved, since almost any outside job has the potential for created a legal conflict of interest. I completely understand why they would have a rule like that, and i imagine all prosecutor's office have something similar. Time for her to go into private practice.

Oh yes. Not like she was moonlighting selling Mary Kay without permission. Now her mother and everybody else know about her little side biz.

It's common in government service to have a rules requiring prior approval of any outside employment, in this case, employment where more than $1,000 is earned. This prosecutor certainly knew the rule and chose to violate it, irrespective of the type of work involved. She took the risk, here. Having said that, I think it's unreasonable for the State Attorney's office to not tell her why she was suspended. By the way, ethically, laywers are supposed to avoid "even the appearance of impropriety." I am not saying that the type of work involved did not factor into this. Just that it may have been enough for the AG to suspend her on her failure to comply with the rule that she must obtain prior approval before earning more than $1,000 in outside work, alone. If she had sought prior approval of the work involved, the outcome of the AG's decision on that would have been very interesting.

Not according to the ethical rules of the two states I practice in. Judges have to avoid the appearance of impropriety, not lawyers. quote: ORIGINAL: gorgeoushair d. I think in NYS lawyers, as well as Judges, are also obligated to avoid the mere appearance of impropriety...

You are right about NY, I went and looked at their ethics rules, although it is limited to "professional impropriety."

I guarantee Ive heard it. The problem is this. If you choose the cheapest, you get what you pay for. If you choose one just because they have big tits, you get what you deserve. That accounts for About 90% of the problems people have.

Like NY, NJ also has rules regarding impropriety. Had she filled out the appropriate form for her supervisor's approval, she would likely be denied. Is working as a pro domme legal in NY? Even if it is, the state isn't going to want one of their prosecutors engaged in an activity that many would equate with being a prostitute. People need to get a grip on reality. It is not puratanical thinking to not want people in certain professions to engage in certain behaviors publicly let alone professionally. Yes, she can go into private practice, but unless she is hanging her own shingle, not many firms are going to want to hire her. On the other hand, if she is in the city, she could easily make a fortune as a kink friendly attorney. In most other areas, she just probably ruined her career and her peers will think of her as a joke in the courtroom. Sad or not, in this area of the country, likely true.

It certainly would not be the image a prosecutor would want to project. Still, outside of public service, there will be firms and clients who won't hold it against her, particularly with her expertise in financial crimes. I don't believe she will get disbarred.

As long as being a pro domme isn't illegal in her area, I don't think she will be disbarred either. I do believe she has done serious damage to her reputation though. The need to get approval to "moonlight" is typically made very clear when you work those government jobs. When I worked for the State of Florida, it was made clear in orientation. Her blatent disregard for rules is going to be a concern for potential employers. Having clients and adversaries think of her as a whore is another. I am not saying she is, but that is what many people in the legal community will think. What a waste. Seems like she had a lot of potential and talent. She threw it away for either greed or a desire for sexual freedom. Eighty grand a year coupled with the reputation she was earning must not have been important to her.
