Doesn't seem to be what the case law says (see above), but OK.  You obviously believe it is unconstitutional.

TheHeretic -> RE: The Clear and Present Danger Posed by Space Captains (9/26/2011 6:55:12 PM)

The first poster does seem a little iffy. The show is obscure, the actor little recognized, it is being displayed by an authority figure to all those squishy little "theatre" majors, and it certainly has a very menacing tone about it, even with the context that isn't on the poster itself. Does it mean students will be challenged to a duel, if they ask a question?

Now the second one being removed was just a power trip by the power mad campus cop cunt, who didn't like being called a nazi. She should be fired for pulling it down, and the university should give it back to him, after paying to put it in a nice frame. [:D]

Lucylastic -> RE: The Clear and Present Danger Posed by Space Captains (9/26/2011 6:57:13 PM)

fired?
LMFAO
thats as dumb as it being reported

TheHeretic -> RE: The Clear and Present Danger Posed by Space Captains (9/26/2011 7:18:58 PM)

Rough day, Lucy? You are usually pretty good about knowing when I'm going over the top for the hell of it, especially when I add a smiley. A day or two, pilloried on the courtyard would probably be sufficient.

Lucylastic -> RE: The Clear and Present Danger Posed by Space Captains (9/26/2011 7:24:37 PM)

no nooooo the peltings will continue till moral improves, I missed the smiley Rich, my apologies:)

WI college campuses have been abridging many speech rights of professors lately.  There was a case of political speech at UW Oshkosh recently, and a bunch of  issues at Madison earlier this year.  Unfortunately, this year has started a trend that might continue for awhile.

I don't think this was a violation of his free speech.  With freedoms come responsibility and the first poster, especially, seems to have been irresponsible.  (Hey, I'm a Firefly fan myself).  Also, the 1st Amendment states that government can not abridge freedom of expression, it never forbid employers from doing so.

EternalHoH -> RE: The Clear and Present Danger Posed by Space Captains (9/27/2011 2:01:45 AM)

Just run this professor through the Bill O'Reilly "nutty professor" machine and let his audience of scooter users write letters and the guy will soon be fired.  Then it will be "problem solved" at the university.

Myself, I'd wonder if Josh Whedon's first amendment rights are being compromised, rather than Professor Miller's. He scripted the episode of Firefly that line's from, after all.

(You're on the money about the university not being the government and so being at liberty to insist posters are taken down for any excuse they can think of, though.)

Victory at UW-Stout: Chancellor Folds after Censorship of 'Firefly' and Anti-Fascism Posters

Chancellor Charles W. Sorensen however, dug a deeper hole. Together with Provost Julie Furst-Bowe and Vice Chancellor Ed Nieskes, Sorensen defended Stout's censorship in an email to all faculty and staff on September 27.

At least 1,000 people wrote Sorensen in defense of First Amendment rights at Stout, and dozens of articles about the case appeared in the national media. Today, Baldwin (co-star of Firefly) wrote about Stout's apparent double standard in censorship. Baldwin noted that earlier this year, Stout apparently had no problem with "Kill the Bill" posters based on the film Kill Bill, which depicted Uma Thurman with a sword and advocated against Wisconsin Governor Scott Walker's budget bill.

Finally, in a letter to all faculty, staff, and students today, the three senior administrators announced that Stout had reversed its decision, is developing a new protocol for handling such cases, and "will schedule workshops and/or forums during this academic year on First Amendment rights and responsibilities in higher education."

The P C police will take a poster down, but it's ok when radical liberals run wild in the State Capital building for nearly three months.

Maybe you shouldn't let imaginary police worry you... I don't ... if a thread gets locked, it gets locked... One thing you won't see me doing is doing a cry-baby act about my right to expression.... I just EXPRESS and fuck whoever doesn't like it. I don't need the "i may be oppressed" preamble anywhere in my thoughts or expressions. If they hint they'll do it, I'll privately tell em where they are fucking up because I at least have the decency to tel the management in private that they fucked up. I won't get into that "it's not fair here" horseshit. It's the internet. Every little corner is owned and unfair in it's own way. And if you're told it's 'special' well you're just getting your chain pulled.
So my advice?Don't preamble with 'I will be called a racist' or "I know the police will <your faulty allegation here>" cause it's just hot air and then you go and post some thinly veiled offense anyway... it's a standard MO here.

Just my opinion here... but I HOPE and I mean this ... That I get away with writing off The STATE OF WISCONSIN as a business loss... cause when I think about how these mother fuckers and their new-found PIETY has brought so much static a into my life and inspired sop mant horse-toothed jackasses to soapbox in front of me. I should in my opinion be able to compensate myself for that lost time from my business
propbably a pipe dream... but what else have we got if we don't have our dreams?

Yes, absolutely so. However it is not any level of government doing it, so I don't think the Constitution applies, therefore the University, while morally and ethically wrong, was within it's rights to remove the posters.

Edit: I seem to recall that there is some sort of rule about having to comply with certain rules and regulations to get federal funding, if so, then that might apply.

FR--

Hell, they could take it down and blame it on the fire marshal.  I've worked in places where you weren't allowed to have loose papers on the walls of the corridor.  All the papers were in glass cases (locked, unfortunately).

The University is a state entity i.e. it is part of the government.
