This is kinda ridiculous. I get the point about it making it easier to track stolen material, but removing cash as an option for people just seems a little too far to me.
it also kinda floated under the radar, and a lot of people there don't even know about it.

That's crap. Like I'm going to take a check from someone I'll never see again. I'm glad I don't live there.
I guess people could just start trading stuff...I'll give you two used coffee tables for one used armchair?

LillyBoPeep -> RE: Louisiana bans cash for buying second hand goods (10/20/2011 6:51:17 AM)

that might be a good work-around -- hopefully now that the news is getting out, they'll contact their reps and get the thing repealed. it's ridiculous. every silly bill gets passed under the "oh it'll help law enforcement!" guise.

law enforcement people get paid to do their job for a reason. it's not an easy job, but taking away a law-abiding citizen's ability to use cash is just waaaaaaay over the line.

So I go into the Salvation Army store and want to buy two paperbacks and have to give a credit card. I can see that going over really well. It's a good way to make sure all these stores close and people buy online from stores out of state. How stupid.

hmmm.. interesting that pawn shops are exempt.

Gawd, that kills garage sales, huh?.. how many of them would take anything but cash??? I can see the cops arresting grandma cuz she accepted cash at her little garage sale.. sting operations... ooh, the arrests and fines will certainly help the govt coffers.. [8|]

So much for "This note is legal tender for all debts public and private"

I was just thinking the same thing.

"This note is legal tender for all debts..." but:

http://articles.mcall.com/2010-04-09/news/all-a5_5warrior0409.7229382apr09_1_debit-sam-s-club-cards

The U.S. Treasury and the Federal Reserve provide information on their Web sites specifying that the ''legal tender'' phrase on our currency does not mandate that cash be accepted as payment for any and every debt.

''Private businesses are free to develop their own policies on whether or not to accept cash, unless there is a state law which says otherwise,'' notes Treasury.

http://5minforecast.agorafinancial.com/the-day-they-banned-cash/

Federal courts have upheld similar statutes in New York, Mississippi and Tennessee. Those laws were more narrowly tailored to scrap metal, but in each case, they were challenged on the grounds that states and cities can’t ban transactions in legal tender, i.e., Federal Reserve Notes.

Each time, the challenges were thrown out.

“States are saying, ‘We have the right to specify the form in which the payments are made, then you can tender the check for any legal tender you want,’” explains Mark Beebe of the New Orleans law firm Adams and Reese. “They’re not saying this is the only medium you can use and that’s where it ends.”

exactly!! people who sell stolen stuff go to pawn shops first thing! excepting them kinda defeats the so-called purpose!

Hillwilliam -> RE: Louisiana bans cash for buying second hand goods (10/20/2011 7:05:17 AM)

I see a lot of small businessmen that are hanging by a thread just say "FUKIT" and close up shop over this.

tazzygirl -> RE: Louisiana bans cash for buying second hand goods (10/20/2011 7:08:05 AM)

I was saying to the man.... yep... just what I am going to do with stolen goods... donate them to the Salvation Army.

LillyBoPeep -> RE: Louisiana bans cash for buying second hand goods (10/20/2011 7:09:24 AM)

debit card transactions cost fees, fees to businesses, and now of course, monthly fees to people who use some banks. money orders aren't free; there's a purchase fee attached to them. and not all banks offer free checks.

so now you're basically having to pay to pay for something. =p that's just inane.

right? =p or some little mom 'n pop antique store. =p

tazzygirl -> RE: Louisiana bans cash for buying second hand goods (10/20/2011 7:09:59 AM)

Just a thought.... there are fees to verify checks.... there are costs associated to running credit cards. Could the bill writer be linked to either, or both, of these services?

LillyBoPeep -> RE: Louisiana bans cash for buying second hand goods (10/20/2011 7:10:59 AM)

^^that's my thought exactly.

i'm going to keep an eye out for something similar should it ever come to NE. it's flat-out ridiculous.

tj444 -> RE: Louisiana bans cash for buying second hand goods (10/20/2011 7:18:02 AM)

and a lot of people that buy used clothes or second hand stuff dont have a debit card or bank account.. geeze, doesnt the govt understand thats why check cashing services do so well? I can just see homeless people whip out their fancy smanchy bank debit card to pay $5 for a winter coat... [:o]

ohhh, and pot growers and money launderers will be outta business too,.. all that money they could wash thru buying stuff at best buy and selling second hand for 10 cents on the dollar.. [8|]

And i wonder if those debit cards you buy at walmart would be accepted, since they are nameless..

MasterCord -> RE: Louisiana bans cash for buying second hand goods (10/20/2011 7:19:45 AM)

It is patently ridiculous - so is the story that it is designed to make it easier to find stolen items - what sort of flea market dealer is going to write a lengthy and accurate description of the item sold on a credit card slip or what sort of thief is going to write on the check they pay with, a long descripion of what they know is a stolen item? Imagine the paper work these people who sell things could have imposed on them.....

The real purpose is to give the government of the state - and ultimately the Feds - a way to track how much money they are missing out on in background economy and ultimately use it as a way to verify people's income from such things. Then they can better figure out how to steal THAT money and initiative from people as well via taxation.

This law is so silly, it makes living here an embarrassment at times.
Call me a rebel, but I'm heading to the thrift stores now, cash in hand!

Along those lines, I wonder how much/if the banks fought this?

Iamsemisweet -> RE: Louisiana bans cash for buying second hand goods (10/20/2011 7:38:09 AM)

People who own pawn shops in Louisiana must have a good lobbyist. People who have garage sales must not.

stupid fucking law based on a stupid fucking idea.

i've said it it before and i'll say it again; just go down to the state house, round all the fuckers up, take them out back and put us out of our misery by shooting every last one of the fuckers.
