Washington (CNN) -- The sweeping health care reform law championed by President Barack Obama was upheld as constitutional by another federal appeals court Tuesday.

The decision is not part of a half-dozen other appeals pending at the Supreme Court. The justices could decide this week whether to take on one or more of those legal challenges to the law. Those suits were brought by more than a two dozen states and a coalition of private groups and individuals.

Tuesday's 2-1 decision by the U.S. Court of Appeals for the District of Columbia is a victory for the administration and its congressional supporters, but only adds to the divide among a range of federal courts over whether the law should be tossed out or severely trimmed in its scope. Three appeals court have upheld the law, while one has ruled it unconstitutional.

sure its as legal as the right to consent.

you know that is legitimate government?

They will now "presume" that everyone has the "benefit" regardless which of course drags everyone into the ever expanding taxing scam.

Just like the consent scam that was contractual which turned into well you are here therefore you consent bullshit.

The real question is simple: How are the liberals going to react when Scalia, Thomas, Alito, Roberts and Kennedy nullify it?

Most of those justices, with the exception of Roberts and Alito, have already supported similar exercises of the Commerce Clause. There is nothing particularly exotic about the penalty payment, and seems to fit neatly into previous court decisions that have upheld the federal government's broad power to regulate interstate commerce.

Thomas, Alito, and Roberts might vote against it, but Scalia and Kennedy have a track record indicating that they would vote for it.

Finally... an admission that there is a clear Republican BIAS in the US Supreme Court. What a pity it comes from a less than credible source.
I am bummed.

We don't know...because the 'liberals' aren't so sure Kennedy is a capitalist fascist. The rest of the right majority we know are as will be exemplified by Roberts selecting which case to consider that will make it easiest to break with Stare decisis and invalidate the AHCA.

Scalia for me, would be a surprise. Seems all of the right wingers on the court favor corporate profits and thus, health care should also...be a profit.

As of yet, no.

My personal favorite part of the Appeals Court's decision:
Court dismissed a Christian group's lawsuit claiming the law is unconstitutional

quote:

The suit in Washington was brought by the American Center for Law and Justice, a legal group founded by evangelist Pat Robertson. It claimed that the insurance mandate is unconstitutional because it forces Americans to buy a product for the rest of their lives and that it violates the religious freedom of those who choose not to have insurance because they rely on God to protect them from harm. But the court ruled that Congress had the power to pass the requirement to ensure that all Americans can have health care coverage, even if it infringes on individual liberty...

"The right to be free from federal regulation is not absolute and yields to the imperative that Congress be free to forge national solutions to national problems."

That's just rich.  Pray for healing?  Don't those religious people know that God helps those who help themselves??
