http://www.nydailynews.com/news/national/texas-runaway-found-colombia-mistakenly-deported-tv-station-reports-article-1.1001207

There was talk on another thread about the need to reform immigration.  We need to reform the way we deport people as well.

In 2010, a 14 year old runaway was arrested for shop lifting; she made up a name for some reason and, according to ICE, never bothered to reveal her real name.  But the name she made up evidently belonged to a 22 year old illegal immigrant who had warrants.  The 14 year old was subsequently shipped off to Columbia.

My question is why didn't the girl reveal her real identity and I come up quickly with the "answer" that she probably didn't want to be shipped back home at the time.  Nor did she believe things would get bad.

Another, and perhaps a more important question, is how did officials mistake a 14 year old for a 22 year old?

14 years olds are stupid and grossly irresponsible.  They can't even be expected to make the right decisions.  But ICE officials acted in a grossly irresponsible manner.

You'd think once she realized she was being shipped off to another country that she'd have been like, "Okay... ummm... I need to tell ya'll something!!!"   (OOF!!!)

Deportation of a minor whose identity was never confirmed. In that picture, she doesnt look 18.

That's why it is the incompetence of ICE that is a fault here.

And MSLA, in her defense, she was a 14 year old stupid kid who had run away from home and wasn't ready to be sent back to her divorcing parents.  Yeah, I'd think she would have said something, because if it was happening to me, I'd have been enough to do so, but then I'm in my 40s and can better look at the consequences of my actions.  Given the same situation when I was 14?  I don't know.  I wasn't in her shoes and I don't know what was going through her head at the time.  ICE is totally responsible for shipping a minor out of the country though.

You'd be surprised what secrets teenaged girls can keep.  I raised one, I know they don't always speak up when they should.

they took the girls fingerprints but deported her before they even confirmed her identity... WTF? Shouldnt that be the first step??? Its not like using a fake name isnt common or anything..

But it doesnt surprise me given how many LEGAL Americans are locked up and some are even deported.. Can you say "Police State"?

4000 LEGAL Americans held & even deported in 2010..

According to this story the 14 yr old girl somehow got a job as a maid in Columbia.. that is how she had been surviving there.. sorta ironic..

My question is why didn't the girl reveal her real identity...

Maybe she figured getting a free trip to Columbia would be kewl.

That would be assuming that they told her they were going to do that... that would be a big assumption, imo..

oh i cant wait for the lawyers to get a hold of this case..

The Columbian government gave her citizenship status upon her arrival.  And now that US officials are hollering for the return of "their" citizen, Columbia is holding her in custody and refuses to return her.  How ironic is that?

People are assuming that she didnt tell them she was an american citizen. As bad as ICE is, she probably did and they didnt listen.

Update:  The young teen will be returning to Texas.

But this is a problem, especially under the Obama administration.  In 2011, ICE has deported nearly 400,000 "illegal aliens".  Many of them criminals, but, according to the ACLU nearly 100 US citizens get caught up in the ICE net each year.

In 2007 Marc Lyttle, a SC resident, US citizen and brother to a US soldier was deported to Mexico after serving time in jail on  harassment charges.  He was detained by ICE upon his release from jail because he had ID to prove his identity.  And btw, Marc Lyttle has a developmental disorder.  Mexico also deported Mr. Lyttle, to Honduras, who deported him Nicaragua and from there he was sent to Guatemala, where somebody was finally willing to listen to his story.  After two years, armed with a new passport and plane ticket, which his family had to pay for, Lyttle finally made it home, but not until after being detained once again by ICE upon arriving at the Atlanta airport.

In 2009, Irving Palomo was detained and sent to Mexico after an ICE "mix up".  And later that same month, Diane Williams, a US citizen of Caucasian and Native American descent was deported to Honduras after completing a jail sentence in TX for prostitution--she had been using an alias.

Northwestern University political science professor Jacqueline Stevens has been looking into the matter, to see if she could quantify the incidents of citizen detentions. She was interviewed for an NPR story:
“I think it’s pretty fair to say that there’s a low but persistent rate of people who are being held by ICE in violation of the law, who are U.S. citizens,” Stevens says.
The “low” part of the incident equation doesn’t bother me – low is relative. It’s the persistent part that I don’t like. Persistence implies repeating mistakes.
Stevens looked at about 8,000 cases in just two immigration detention facilities. She found that about 1 percent of the time, people were eventually let go because they were U.S. citizens. However, that meant the citizens were held between one week and four years in detention.

well,.. i for one am sooooo grateful to be white and speak perfect english...

Cripes.. detained for 1 week up to 4 years? deported even when you tell them you are a legal citizen? Imo,.. cuz Hispanics put up with this crap, it keeps happening.. if they did what a normal white person would do (sue the shite out of the govt), maybe the govt would finally change their policies.. Sure, there are a few that sue but not enough, it doesnt sound like this girl's family will either..

Have you ever seen "born in east la"?
it came out in 87
this is NOT a new issue, It became a larger issue after 9/11
being held by immigration is a fucking nightmare no matter where you are. Or what age you are. It sure as hell shows the problems in the system doesnt it.
Maybe we should hand immigrant herding over to private companies who have even less regulatory systems in place to detain someone wrongly.
Shes lucky she is american and not columbian, she sure as hell wouldnt get the same uproar if she was mexican and sent to columbia by accident.

No, never saw that one...

I think 9/11 has made it much worse and I have read articles that say under Obama, more immigrants have been deported in the couple of years he has been Prez than the total under Bush's 2 terms.. so even more legals will have gotten caught up in it the last few years.. Private companies probably would be easier to sue and hold people accountable, with govt there seems to be no accountability at all.. All that ICE had to do with this girl was wait to get verification on her fingerprints.. how hard could that have been?

I wonder how she feels about it, if she feels lucky to be an American.. how can someone feel good about a country that treats them like that? the US just tossed her on a plane to an unknown fate..

Professor Stevens says that about 1% of all the detainees at the two detention centers (prisons) she looked at are verifiable US citizens.  Given that the Obama administration has deported nearly 400,000 people in the last year alone, that is potentially nearly 4,000 American citizens being detained and possibly deported.
