Score one for Freedom of Religion.

A federal appeals court upheld a Nov. injunction against the so-called OK sharia ban.  A huge reason for the appeals to finding this ban unconstitutional is that it could have nullified wills and legal contracts among American Muslims which often reference Islamic law in the documents.

kdsub -> RE: Sharia ban in OK overturned (1/12/2012 7:23:58 AM)

“Opponents also say it could nullify wills or legal contracts between Muslims because they incorporate by reference specific elements of Islamic prophetic traditions”

Tradition is different then specific sharia law. This has nothing to do with freedom of religion but discrimination against any religion.

What the courts are saying in my opinion is laws are written by the people through their legislators. Unless these laws are in conflict with the Constitution it should make no difference where or what religion or tradition the roots for these laws come from.

"Defenders of the amendment say they want to prevent foreign laws in general, and Islamic Sharia law in particular, from overriding state or U.S. laws."

Could someone explain the whole thing?  Courts are required to interpret cases using first laws specific to their locality, and second, laws within the US.  They are permitted to cite foreign laws as substantiation, but to give them less weight than US laws, and I doubt they'd ever make any impact unless there was no applicable US law.  In other words, this amendment is completely unnecessary.

outhere69 -> RE: Sharia ban in OK overturned (1/12/2012 9:32:36 AM)

It's basically hysteria, and good for elections ("OMG!!  You voted against our amendment!!  You want the downfall of Christianity!!)

Next thing ya know, they'll be going after the Hasids.

Now why am I not surprised at that comment.
Doesnt matter what the law says, some have to scream out and hold their "rights" even tighter in fear.

Why would you think gun shopping would be necessary?  There have been millions of Muslims in the US for years--living peacefully and largely unnoticed until 9/11.  They don't want Sharia Law to replace our legal system, they just want to be left in peace to worship their god however they chose.  And here I thought this was a free country where people could actually do that.

joether -> RE: Sharia ban in OK overturned (1/12/2012 10:25:03 PM)

This law was silly and unconstitution when it first made the news. It was silly and unconsitutional when placed on the voting ballot. It was silly and unconstitutional when approved. And its STILL silly and unconsitutional now now that its been destroyed in the courts.

But how much money was spend to bring this from idea to law?

I bring it up, since the people who were/are in favor of this law, are also the same people that bitch that goverment wastes money on stupid stuff: conservatives. Did not one of these people stop and asked themselves "If we can do this, what keeps all the athesists and agnositcs from creating a law that bans Christian laws from the books?" More so, if atheists and agnostics had actually done this BEFORE this 'anti sharia-law' act was passed, how many conservatives would have yelled of it being silly and unconstututional? ALL OF THEM!

But then conservatives needed to hide their hatred and ignorance while spending a heap of money on something that wouldnt stay active for very long. How much money have they spend on this stupid law? Couldn't the money have better been spent on something useful for those in that state? Like jobs?

And how do you know? Do you know those people? Speak their language?
You could be walking behind them in the Mall and all of a sudden it's "Allah akbar!" and "KA-BOOM!"
Next thing you know *you're* one of the "72 virgins" and some guy with no arms and one eye with smoke coming off of him is chasing you around with a hardon! Then *you're* yelling "Allah akbar" and wishing you could get your hands around the neck of any politician who voted to let the savages in.
And forget the the big shoe sale at Sears!
You never know when they're going to go off!
I don't understand how our govt. thinks they can "tell" us that we have to live with them. Ted Kennedy did that too but look where he lived!

Joether, get spell check.
You have to understand that many people don't consider "islam" to be a "religion" but a cult.
Don't they get a say?
Don't you belong to a group that uses the phrase, "Non-Believers?"

mnottertail -> RE: Sharia ban in OK overturned (1/13/2012 12:05:04 PM)

they can have all the bitching 'says' they want, nutters can howl,  it just aint law of the land.

No more of a cult than Christianity in that case.

That is one of the most hateful, ignorant, close-minded comments I've read in a long time.  This country was founded on Freedom of Religion.  See my thread further down on the 5 Founding Fathers who would be unelectable today were they to run for the GOP nomination.  All but one of them, Thomas Paine, was elected president.  And all of them had some scathing things to say about the Christian religion.

http://www.alternet.org/story/153727/5_founding_fathers_whose_skepticism_about_christianity_would_make_them_unelectable_today?page=3

For instance, in a 1790 letter to Touro Synagogue, Washington assured American Jews that they will enjoy religious liberty, not mere tolerance in a Christian nation.  This is quoted from the letter:  "For happily the Government of the United States, which gives to bigotry no sanction, to persecution no assistance, requires only that they who live under its protection, should demean themselves as good citizens.”

Showing bigotry to any group of people because of the actions of a few, because of their religious beliefs, their skin color, sexual orientation or whatever comes only from an ignorant mind.

eireangel, is that the oldest synagogue in the country, in Newport, R. I.? I've seen that when I was in the Navy. Nice building.
No-one has a problem with Jewish people, they're pretty cool. They haven't smashed any airplanes into buildings in,.....oh, a dog's age I recon.
And their M.D.'s don't join the Army and kill a bunch of people down in Fort Hood like,...ahem,...
And last I checked, no Jewish person has lit their hairy testicles on fire trying to blow up an airliner right?
You must be aware that *anyone* or any group of people can call themselves, "a religion" right?
Look at the Westboro Baptist Church, they're their own "religion."
How come so many "religions" hate other religions? More wars have been fought over "religion" than anything else in human history.
How about the nazis? One could argue that they were a "religion" too with all that "thousand year" crap and mumbo jumbo about the holy grail. The nazis were started by Hitler. And "islam" started by a sicko child molestor.
What if someone wanted to start, "The Church of Rape", you cool with that?
And what about the KKK, they're always quoting the bible and burning giant crosses, aren't they a "religion" too? They are if they fill out the proper paperwork.
I don't want anything to do with those groups. Or the Westboro Baptist "church." I don't have to "respect" any of them or....any religion if I choose not to. It's a free country, right?
Nice, I'm "hatefull", "ignorant" and "closed minded" because I have a differant opinion than you? (Oh, I forgot "disgusting.")
It sounds like you're bigoted against people who don't agree with your way of thinking.
