An unemployed person in Illinois is qualified for unemployment unless there is misconduct, which "has been defined as conduct evincing such willful or wanton disregard of an employer's interests," according to the state's legal test in a ruling from the board of review.

In the case that established the precedent in 1987, an ambulance driver was fired after having four minor accidents in three months backing up a vehicle. The hearing officer and state agency denied his unemployment claim, but the state supreme court said the law requires "evil design" or wanton disregard of its interests, and that test was not satisfied.

It sounds ridiculous but you can be assured there was more to this firing then working through lunch. That was just the excuse to get rid of her.

I’ve had to do the very same thing over the years. Often an employee that is a bad worker will not do something bad enough at any one time to justify firing. So the boss is just waiting for the one mistake to get rid of them.

As we know we all break the rules at our jobs one time or another and if they want to say goodbye they will be watching for you to break the rules.

ok, what was that at the bottom about an ambulance driver having accidents? if you cant properly drive the ambulance then you could end up exacerbating an injury or even killing sombody.... now what does that have to do with sombody working during lunch?

At my former job it was mandatory that you take your entire hour and 15 min lunch. If you did not then you would be written up and after three times you would be fired.

There were times I worked during my lunch though because I still had customers that I couldn't walk away from. I had to finish their transactions. My boss would come over and yell at me to go to lunch. I'd just point and ask her if she was going to take over and she'd just walk away. I mean it's a no win situation.

Why not...it just takes enough complaints by customers or fellow workers to get the bosses attention and start watching. I'll bet you have had to work with someone, maybe for years, I have...who is not performing to standards but not bad enough to get fired outright. Maybe a new boss or pressure on the company exposed this woman’s less then stellar work history.

It just comes down to common sense...no employer would use breaking that rule to fire a GOOD employee. If they had to downsize that would be straight forward and would not have to use that excuse. Of course none of us know the full story and that is my point. I am making assumptions but so are you.

News organizations are always looking for these type of stories and conveniently leave out details that would give the story a different light…While the employer is restricted by law on what they can say to the media.

If they had other complaints, they would have voiced them. They did not. They stood on that one complaint.

I have a feeling it had more to do with finances.

How do you know they had no other complaints... that is privileged info and they can be sued for releasing it... or at least a EEOC case can be made...believe me I know.

I just refuse to follow the crowd in demonizing this business when I don't have all the facts... And what supposedly facts we do have come from a media source.

And its another to blindly believe all you hear in the media. How many times right here in CM has a member been moderated and complain giving a one sided story the mods are not allowed to comment on?

This may be a vindictive boss but it may also be as I described… we just don’t know. Certainly we don’t know enough to demonize the company with certainty.

I didnt say it was a vindictive boss. I said its probably more financial. She was not a high power executive.. she was a secretary. After ten years, Im sure thats one healthy paycheck.

Could be so or not...although I don't know the size of the company or their unemployment insurance and history which would be needed to make an intelligent guess …Are you privy to that information?

Not knowing the above do you think it fair to paint the company in the light of many of the posters in this thread?
