slavesilk -> Shooting fetish video (NOT porn) in hotel room (NYC) -- Legal or no? (2/12/2012 1:13:32 PM)

Sorry if I'm posting this in the wrong place, but thought I would give it a shot. I live in NYC and I'm considering starting up my own nylon fetish site with stories plus videos. I have no problem finding models, my only issue is finding a place to shoot. I would go with photography studios (believe me, there are plenty of affordable ones) but none of them have any furniture in it whatsoever. I need at least a bed, table, some chairs, a couch, separate rooms (bathroom, kitchen, bedroom, living room). A photography studio is just one big blank space and nothing more.

So I found some affordable hotel suites around NY that have exactly what I'm seeking. The question is whether or not I would find myself in some kind of trouble with the hotel if I were to bring in two female models plus my equipment (which is not very much). Now I can understand if I was shooting a porno (which I am not), but these would be nylon fetish videos that contain female teasing/denial, bondage, domination, roleplay, some sensual kissing/touching, as well as light facesitting (CLOTHED, never nude). The models would never be fully naked.

Would this be a problem if I were to do this in a hotel suite in NY? If yes, then where would be a more suitable place to do something like this?

You don't have these things at home?

Of course I do, but shooting in my home is not an option, unfortunately.

Good luck?

Guys, I'm just looking for some advice/insight into this matter, that's all. I'm not trying to break any rules or anything like that. If you know any info that would help me out with what I'm trying to do, then great please do tell. If not, then nevermind.

The models are of age? You have all the required consent forms that the government insists you keep on record forever? Proof of identity, immigration status, consent forms, proof of age?

The hotel shouldn't object if you say you are having friends visit as long as you don't destroy anything or are noisy enough to bother the neighbors.

Des... thanks, that's exactly what I was looking for :) I was also thinking, just as a precaution, I can bring in my own bedsheets/pillow case (and similar items) for the video to replace what they have in the hotel (that way no one from the hotel can say that we filmed on their bed and what not), then I'll put the hotel sheets, etc. back after filming.

Regarding the first thing you said... Yes, the models would be of age. I know of the 2257 Compliance Form, I will have to make copies of their state ID or driver's license to keep on file, I do know there is a model consent form but I don't have all the details to this. Would you know where I could find the exact forms required for this?

Thanks. Just trying to do my research before all else.

Hotels really don't care what you do with their rooms, as long as you pay, don't disturb the other guests, and don't trash your room too badly. I've seen plenty of semi-pro porn shot in hotel rooms.

I don't think it legally makes much of a difference where you shoot your porn. If you're really worried about legality, though, you should talk to a lawyer. Have him look over the model release you plan on using and look into obscenity laws, etc. If you're planning on charging for your fetish site, you'll need a tax lawyer, too.

I'm baffled that you think this will be a problem. Just....don't give them copies of your fetish shoots to review? Seriously, the people from your local Holiday Inn aren't patrolling porn sites looking for a glimpse of their signature grey carpet.

Bud.....this is America, you can do anything here you want to.

You read the Constitution I presume (somewhere along the line). Don't show any labels/markers/advertising mechanisms regards the hotel, don't be stooooopit and do shit in the hallways or stairs (or elevators) unless you control the entire space. If you don't (unless as fore-mentioned, you rented the entire space), you're golden.

If you rent it....it's legally your abode....as if it were your home (with some nominal legal exceptions). Indeed, so long as you're the renter....it IS yours.

I only have a few clues left, but there are several available elsewhere......

Get one!

(You do read....like words and such....literature....news....that kind of thing.....don't you?)

Even though you classify yourself as a fetish site, you're still considered a porn site and will be given the same rules to follow as a porn site online. You're going to need an attorney anyway if you're going to run this as a business. So at that point I'd talk to him as to the legalities.

Well, there is of course....that.

MistrixMsE -> RE: Shooting fetish video (NOT porn) in hotel room (NYC) -- Legal or no? (2/12/2012 9:13:26 PM)

as long as no hotel logs etc are visible, you do it in the room, and out of view of other guests (no balcony shots etc) you are legal... if a hilton logo on a guest info card is showing, that could be an issue.. if it were ever seen anyway

fucktoyprincess -> RE: Shooting fetish video (NOT porn) in hotel room (NYC) -- Legal or no? (2/13/2012 6:55:40 AM)

I think as long as the hotel is not identifiable in the film/photos, it should not be a problem. I would just be careful not to include anything in your shots that would make anyone say, "oh they shot this at "X" hotel". If the hotel is easily identifiable (i.e., the view through the window, or unmistakable architecture or design, etc. - because the city does have readily identifiable hotels), you might have a problem. I think anything that could make the hotel appear to approve in anyway of the content of the film/shot where the hotel is identifiable could be grounds for a lawsuit. (Just like you can't have a Coke can sitting on the nightstand either, because trust me, once you start distributing your film in any way, shape or form, the company will absolutely sue you for unauthorized use of their product - I would think a readily identifiable hotel in New York would have similar rights.) If you want a more reliable answer, you really need to consult a lawyer.

Hillwilliam -> RE: Shooting fetish video (NOT porn) in hotel room (NYC) -- Legal or no? (2/13/2012 7:30:03 AM)

Consult your attorney and tell the hotel that you are interested in a fashion (lingerie) shoot and see what the manager says.

Disclose what you wish to do in writing and you might be surprised that they don't care as long as you pay for the room.

GreedyTop -> RE: Shooting fetish video (NOT porn) in hotel room (NYC) -- Legal or no? (2/13/2012 8:44:22 AM)

at the hotel I work at, we don't give a rats ass as long as the credit card clears, ya don't trash the room, don't smoke in the room, and don't disturb the other guests, oh, and no furry pets (we have a no pet policy).

to the person that mentioned generic carpet: there IS no generic carpet/furnishings. Properties are given a book of acceptable choices, different carpets/artwork/furnishings/etc and you get to choose from 5 or more schemes. The books are not entirely chain proprietory. So a carpet(or whatever) you see at Holiday Inn might also appear at La Quinta. Just saying.

I do agree with the make sure there are no identifying brand names/specifics visible.

Best plan is to talk to your lawyer first, draw up a proposal, present it to the GM of the hotel. be as vague about the nature of the shoot as you/lawyer can possibly make it.

plausible deniability.

This. I can tell you right now, if my father found out that his hotel had been used for a porn shoot and it was instantly recognizable, he would chase you to the ends of the earth to sue you for damaging the image of his hotel.

And I personally feel he would be entitled to every single penny he could lay his hands on. I think something like this could give a hotel a "seedy" reputation, and while some places thrive on that exact reputation, it is not one that most typical hotels would want.

But he'd watch the video first :)
