Occupy settlement clarifies citizen rights in city parks

Local legal experts, civil rights lawyers and Occupy Cincinnati members praised a settlement reached Monday between the city of Cincinnati and Occupy Cincinnati, which scrapped about 300 criminal cases against protesters and ended a federal lawsuit against the city.

Others said the city should have defended its former park rules, including at least one property owner around a park where the city has pledged a small “open area” for 24-hour public use.

City officials, however, contend the settlement filed Monday morning merely clarifies any citizen’s rights in a city park.

“If anything, this case brought to light that our park board rules were not current,” said Cincinnati City Solicitor John Curp, who spoke Monday on behalf of the city. “Those rules have been revised ... rules we believe are now valid and constitutional.”

Occupy Cincinnati formed in the fall, inspired by the international Occupy Wall Street movement. Soon after, a member requested a 24-hour permit in Piatt Park at the corner of Vine Street and Garfield Place for the purpose of continual protest against corporate greed and economic inequality.

The Cincinnati Park Board denied the permit, its director Willie Carden arguing the board had never issued a permit for such a long stretch of time and wasn’t about to start.

Dozens of individuals chose to stay in Piatt Park after closing time in response, accepting police citations or arrest for trespassing. Five individuals then filed a federal lawsuit against the city, claiming the park rules violated First Amendment rights to free speech and assembly.
