That is not sufficient cause to declare a law "NOT un-constitutional".

The Supreme Court as of 2002 has overturned over 1300 laws by reason of them being unconstitutional.


The person I was responding to, was stating (if memory serves correctly...) thatt he ACA was un-Constitutional because it didnt go through the correct and whole process. I was pointing out that the bill had gone through several incarnations. The President had one, the House, The Senate and the final version. The President's version was the best of all of them. In those fourteen months, Republicans tried EVERYTHING they could. Legal and otherwise to undermine the whole bill. The did suceed at watering down the bill from "Pretty good for all Americans" to "Decent...". You might recall the President holding events with key Republicans at a 'round table' like events before the public to ask questions and find a way to comprise on things. At that time (like now), Republicans were/are the 'Party of No!'. They did ask for a few things to be put into the bill, in exchange for their votes as 'yea' instead of 'nay'. Those things (which is what watered down the bill) were inserted. What did the Republicans do? They all voted 'nay', and thus, showed how much honor and decency they REALLY hold. That is the point that Congress began to accomplish nothing useful for the American people. Could you blame the Democrats, for not trusting the Republicans on anything after that? By doing that tactic, Republicans lost all credibility.

The ACA did go through the whole process correctly and therefore was consitutional. It came up before the House. The House debated it, and voted on it. Was sent to the Senate who debated and voted on it. Than the House and Senate got together to make sure their individual versions matched, debated and voted on it. Than it was sent to the President at the White House who read it and signed off on it. THAT is how its suppose to work.

However, just because a law is passed doesnt make it constitutional. They went through the process. But many laws are found later to be unconstitutional.

However, you are right in that it did go through the proper process in Congress.
