Just when you think you have heard of the dumbest law ever,another one pops up.
"Arizona marches to the beat of its own drummer. But if that drummer gets upset and starts hollering on the Internet, he might get tossed in the clink.

After spending years targeting illegal aliens, the Grand Canyon State is turning its sights on obnoxious Internet users (commonly called 'trolls'). A new update to the state's telecommunications harassment bill could make the practice of harassing people online illegal.

Arizona House Bill 2549 has already passed both of the state's legislative bodies and is currently sitting on the desk of Governor Jan Brewer. While there's a lot in there that doesn't concern trolling, here's the line that has people worried:

It is unlawful for any person, with intent to terrify, intimidate, threaten, harass, annoy or offend, to use ANY ELECTRONIC OR DIGITAL DEVICE and use any obscene, lewd or profane language or suggest any lewd or lascivious act, or threaten to inflict physical harm to the person or property of any person.

Violators could be charged with a Class 1 misdemeanor and face up to 6 months in jail. If electronic devices are used to stalk someone, the charges then become a Class 3 felony, with penalties ranging from a minimum sentence of two and a half years in jail for non-dangerous offenders with no prior record to 25 years.

At the heart of the bill is an anti-bullying agenda. Cyber-bullying has been on the rise in recent years and has been in the news lately. A 2010 report in The New York Times found that one of out five middle-school students said they had been victims of cyberbullying.

Despite its good intentions, the Arizona law is already being called "overly broad" by critics. By using vague terms like "annoy" and "offend," it could easily encompass Internet forums or even comments like the ones found at the end of this story.

Free speech groups say they don't believe the law would ever stand up to court scrutiny if Gov. Brewer does, in fact, sign it. And many have pointed out the flaws in the bill to the governor herself.

"Government may criminalize speech that rises to the level of harassment and many states have laws that do so, but this legislation takes a law meant to address irritating phone calls and applies it to communication on web sites, blogs, listserves and other Internet communication," Media Coalition wrote in a letter last week."

Harassment and stalking are wrong. This appears to be aimed more at those high school and middle schoolers who do this to an unliked classmate. As not even changing schools will stop this kind of thing, there have been several suicides of children who were subjected to this.

It may need to be clarified in language, but it should be criminalized to do this sort of thing.

I tend to troll when I have morons who write Me idiotic emails. But would never target anyone purposely.

The unmentioned part is HOW LEOs would track down trolls. They'd need to be granted the power to get ISP records.

While I will agree that cyber bullying and stalking are wrong,from the broad descriptions in this article it might cover a lot more than intended.And I am not sure just how they can deal with the amount of **** hurt people that will complain about getting their feelings hurt.

Not only the how they would track them,but what about someone in another state harassing,cyberbullying or stalking someone in Az.?And just how hard will a cop try tracking someone down because they called someone else they never met in person a poopyhead? There is just too fine a line here between someone's right to free speech and someone else's right to not be bullied or stalked.

All this bill needs now is the governor's signature to become law. 

I guess when I'm in Arizona I'll have to be nice to the horny net geeks on yahoo.  Ooops, that term could annoy the horny net geeks and that is against the law.  Sheesh, this is not going to be easy. 

I would assume that people in Arizona could record IMs they had with people from Arizona who they didn't like and have the person arrested if they became annoyed.  No calling someone an idiot anymore.  No more remarks in the forums that give advice the OP does not seek.  Just agree with everyone.  Write nothing and you can't break the law.

In related news, AZ state police have rounded up a number of long-limbed mythological creatures who were loitering under bridges. They also raided a local toy store, finding the following dangerous creatures:

Why not save everyone a lot of time and trouble and turn Arizona into another Gaza? It seems intent on having the largest prison system in the world, so why not rationalise things and design it from the get go?

They could build a huge concrete and steel fence around the State, with watchtowers and machine gun nests, declare a variable no-go zone for 100-1,000 metres and shoot or imprison anyone who ventures too close. Man the frontier with designated trustees with solid track records in shooting innocents. This will keep Arizona free from contagion and sin (and those nasty illegal tinted people too), and leave the residents/inmates free to choose which century they wish to inhabit.

As it looks like it's only a matter of time before breathing fresh air becomes a serious felony in Arizona, I'm sure the residents/inmates are already resigned to their fate.
