WASHINGTON -- A Wisconsin law that made it easier for victims of wage discrimination to have their day in court was repealed on Thursday, after Wisconsin Gov. Scott Walker (R) quietly signed the bill.

The 2009 Equal Pay Enforcement Act was meant to deter employers from discriminating against certain groups by giving workers more avenues via which to press charges. Among other provisions, it allows individuals to plead their cases in the less costly, more accessible state circuit court system, rather than just in federal court.

In November, the state Senate approved SB 202, which rolled back this provision. On February, the Assembly did the same. Both were party-line votes in Republican-controlled chambers.

SB 202 was sent to Walker on March 29. He had, according to the state constitution, six days to act on the bill. The deadline was 5:00 p.m. on Thursday. The governor quietly signed the bill into law on Thursday, according to the Legislative Reference Bureau, and it is now called Act 219.

Walker's office did not return repeated requests for comment.

State Sen. Dave Hansen (D-Green Bay) and Rep. Christine Sinicki (D-Milwaukee), the authors of the Equal Pay Enforcement Act, criticized Walker on Thursday for not informing the public of his actions on SB 202.

“We are finally starting to see progress here in Wisconsin, yet like their counterparts across the country, Legislative Republicans want to turn back the clock on women’s rights in the workplace,” said Hansen.

Women earn 77 cents for every dollar that men make. In Wisconsin, it's 75 cents, according to the Wisconsin Alliance for Women’s Health (WAWH), which also estimates that families in the state "lose more than $4,000 per year due to unequal pay."

Business associations lobbied in support of SB 202, according to the state's Government Accountability Board. Groups like Wisconsin Manufacturers and Commerce, and the Wisconsin Restaurant Association all backed a repeal.

Sara Finger, executive director of WAWH, said that the repeal was a "demoralizing attack on women’s rights, health, and wellbeing."

"Economic security is a women’s health issue," she said. "The salary women are paid directly affects the type and frequency of health care services they are able to access. At a time when women’s health services are becoming more expensive and harder to obtain, financial stability is essential to maintain steady access."

Walker is facing a recall election in June. The two frontrunners on the Democratic side who are competing to unseat him, former Dane County executive Kathleen Falk and Milwaukee Mayor Tom Barrett, sharply criticized the governor for allowing the repeal bill to become law.

Falk said Walker has "turned back the clock for women across Wisconsin."

"As a woman and as a mother who worked full-time while raising my son, I know first-hand how important pay equity and health care are to women across Wisconsin," she said in a statement to The Huffington Post.

A spokesman for Barrett's campaign said that Walker's "ideological civil war includes a war on women, and repeal today of this protection against pay discrimination is a major step backwards for Wisconsin values and basic fairness."

"Tom Barrett knows equal pay for equal work is essential, and failing to stand up for Wisconsin women in the workplace is yet another reason he [Walker] must be defeated this summer," he said.

UPDATE: 2:17 p.m. -- The Plum Line reports that President Barack Obama's campaign spokeswoman Lis Smith responded to Walker's repeal, calling on former Massachusetts Gov. Mitt Romney, the frontrunner for the GOP presidential nomination, to take a position on the issue.

"As he campaigned across Wisconsin, Mitt Romney repeatedly praised Governor Scott Walker's leadership, calling him a 'hero' and 'a man of courage,'" she said. "But with his signing yesterday of a bill make it harder for women to enforce in court their right to equal pay, Walker showed how far Republicans are willing to go to undermine not only women's health care, but also their economic security. Does Romney think women should have ability to take their bosses to court to get the same pay as their male coworkers? Or does he stand with Governor Walker against this?"

Apparently, men need to earn more money than women

As Jessica Pieklo reported yesterday, the Governor of Wisconsin, with little notice or discuss, repealed the state’s Equal Pay law.  For Scott Walker, it was no doubt the most logical step in his ongoing war on women and the working class, as the Equal Pay Law protected not just women but any protected class.

But for the Republican who was most enthusiastic about rescinding the law, it was really about fairness.  After all, according to him, money is more “important” for men.

Over at the Daily Beast, Michelle Goldberg writes a detailed account of the repeal and the effect it will have in the state.  Goldberg also interviews Republican state senator Glenn Grothman, who was an enthusiastic fan of repealing the law.  According to Grothman, not only is there no actual pay gap between the sexes, if there was one it wouldn’t matter anyway.  After all, men need money more than women do, since they have families to support.  “You could argue that money is more important for men,” he told Goldberg.  “I think a guy in their first job, maybe because they expect to be a breadwinner someday, may be a little more money-conscious. To attribute everything to a so-called bias in the workplace is just not true.”

Grothman’s views on women in the workplace is very 1960′s sitcom to start with, but his understanding of breadwinning is even more so.  Many families have two breadwinners, as both partners either chose to or have to both be in the workplace.  And the majority of families lead by just one parent have mothers at the helm.

Then again, when asked about his source for his figures that prove there is no wage gap between the sexes, Grothman stated it was Ann Coulter.  That’s sound research to base legislation on.

This is America. If you don't think you are making enough money you are free to go find a job somewhere else. I would venture to say that in 90% of the cases where women claim they aren't making as much as the man, they are probably worthless employees.

I also suspect they did a great job at first since they were young and halfway motivated, but then like government employees and union workers, think they can just sit on their ass the last 20 yrs and get a taxpayer funded pension.

Maybe women need to take advantage of their non-economic power in Wisconsin and stop providing a particular service to men until this problem is resolved???
Can you guess which service I'm talking about?
How long do you think the men in WI could last before Walker himself would be calling for the return of the equal pay law???

Edit: It isn't BJ's I'm talking about, though those should stop too. I think the women in WI should just take their advice from Rush and put an aspirin between their knees until the equal pay law is restored...

They also do silly shit like take time off for childbirth and caring for their young children, setting their career paths behind men who worked through it while she took care of the rest.

The rest of your silly rant would apply equally to men, so not the case here.

Here we go again

All Walker did was sign a bill that makes the FEDERAL courts pay for FEDERALLY mandated lawsuits. Women can still file discrimination lawsuits, nothings changed except the venue.

What the hell?

If the business has its operations exclusively in Wisconsin, then state court should be the ONLY option. Period.

Yeah, I agree that the law provides an unreasonable bat to pressing discrimination suits. Between union-busting and now this, the WI GOP is so pro-business it's sickening.

An Act to repeal 111.39 (5) (d), 111.397 and 893.995; and to amend 111.39 (4)

111.39 (4) (d) The department shall serve a certified copy of the findings and
3order on the respondent, the order to have the same force as other orders of the

6equity. If the examiner finds that the respondent has not engaged in discrimination,
7unfair honesty testing, or unfair genetic testing as alleged in the complaint, the

Yeah, women earn a lot less. The issue isn't women leaving the workforce to have babies or be homemakers as several of them don't these days. Many women will take 6-8 weeks maternity leave and be right back at work, full-time. My daughter has done it. And 2 or her 6 week maternity leave were technically vacation days she had saved up. She works in a factory making fire hoses and earns $3 less per hour than men who were hired after she started at the plant. FOR DOING THE SAME JOB!!

And my sister was a bank vice-president near Nashville. She earned $95,000 a year while the male vice presidents at the same bank earned over $100,000. She faced the same when she started in banking in San Francisco--making thousands a year less then her male counter-parts.

Is it any wonder the Wisconsin Restaurant Ass. would back such a bill? Waitresses make below minimum wage as it is because "they earn tips". But more and more you hear about people who don't tip because the waitress is "just doing her job" and should be expected to do it well and not expect anything from the customer.

Lookie, I am the last person to sympathize with women who leave the work force, and then come back when their kids are grown, trying to insist that having been a soccer mom is a job skill. Women who made the decision to leave the job market to raise kids need to expect to start at entry level. But I have been working non stop since I was 14, except for one year after my youngest son was born and I was going to law school. Surely you would agree that someone like me should be able to redress any pay inequality based on my sex without jumping through a bunch of hoops. So no, I am not going to "get over it."
