Article 88 of the Uniform Code of Military Justice (UCMJ) prohibits commissioned officers from speaking or writing "contemptuous words" against the President, the Vice President, Congress, the Secretary of Defense, the Secretary of a military department, the Secretary of Transportation, or the Governor or legislature of any State, Territory, Commonwealth, or possession in which he is on duty or present.

DOD Directive 1344.10 extends this prohibition to all active duty personnel, including enlisted.

In fact, two PACAF enlisted people were recently handed nonjudicial punishment for repeatedly forwarding e-mails containing offensive material involving President Clinton and Monica Lewinsky.




SUBJECT: Political Activities by Members of the Armed Forces

4. POLICY
It is DoD policy to encourage members of the Armed Forces (hereafter referred to as
“members”) (including members on active duty, members of the Reserve Components not on
active duty, members of the National Guard even when in a non-Federal status, and retired
members) to carry out the obligations of citizenship. In keeping with the traditional concept that
members on active duty should not engage in partisan political activity, and that members not on
active duty should avoid inferences that their political activities imply or appear to imply official
sponsorship, approval, or endorsement, the following policy shall apply:

How does he have a case? He signed a contract that he would follow the rules, the rules state that he would not disparage his commander in chief and that he would follow order. He disparaged his commander and he openly stated that he would not follow orders. For that he fired. So where does he have a case now?

So what sort of 'Other Than Honorable Discharge' did he get? The three I remember from my days in the Navy (back when the world was in black and white) were Undesirable, Bad Conduct, and Dishonorable. Any current/recent military know which they use for people inciting mutiny and disloyalty?

Nope. Freedom of speech does not apply to employment. Especially when you've signed a contract which outlines your code of conduct. It only means that you cannot be persecuted for your speech.

Do you see how this thread, and this type of thread, is turning and turns into the usual conservative liberal camps? It is always frustrating to see how shallow people are when they forget their so called moral base to match their political views.

Damn he was wrong…deserved what he got…but so was the damn Marlins coach…and all other loud mouths that think freedom of speech goes without repercussions and that includes some of the occupy ding bats.

Please folks be consistent and forget your political stance.

ps... not you in particular Owner59 you are pretty consistent but in general.

I actually see more people agreeing, that generally do not agree politically.

As HW just said, AZBM has a good point. When you sign up for SOME jobs, you are agreeing to more than just a paycheck.

To me, it wouldn't matter if the soldier was a liberal trashing GW, whom I couldn't stand and did plenty of trashing on my own. As a soldier, with the president as your commander, there is a certain expectation of behaviour. If you cannot maintain that expectation then you need to get your ass out of that 'job'. Then trash talk the commander in chief allllllllllllllllllll you want. Just like we civilians do.

(my only suggestion is to avoid any hint of bodily harm......right Nug?......)

Pretty sure he got a General Discharge Under Other Than Honorable Conditions. From the news article it seems like he got NJP rather than a Court-Martial and I think a General Discharge UOTH is the worst discharge you can get from NJP.

You seem to ignore the fact that he was given several chances to stop by all his commanding officers, which he refused to do. I served back in the 70's and 80's, even then you where not allowed to publicly speak against the President, so it is not like it's a new rule.

As for the freedom of speech, he exercised his freedom of speech, there are however consequences for what you say even in public life, not just the military. Being in the ARMED FORCES the price you pay is being discharged, he knew that and he accepted that when he continued to post he would not follow the Presidents orders, then changed it to unlawful orders.

The rule now (don't know if it was the rule, then) is that military personnel have freedom of speech when they aren't representing the armed forces.

For example, they're allowed to march in political rallys. But not to do so in uniform. If they aren't in uniform, then they're a citizen. If they're in uniform, then it's like they're saying that the uniform endorses (whatever the rally is about).

Write a letter to the editor of your local newspaper, and sign it Joe Blow, and you're good.

Write the exact same letter, and sign it Sgt Joe Blow, USMC, and you can, technically, face court martial.

I've been told, by current military personnel, that these rules are part of UCMJ (technically, you can be court martialed for them), and that personnel are briefed on these rules, and what's allowed and what isn't.



Face Book is privately owned, not part of the Military. To quote General George Washington "When we asume the soldier, we never set aside the Citizen". This was on a poster the Pentagon had printed and distrubited during the American Bicentenial.

First off he was not involved in partisan politicats nor was there any appearence that this was some official statement, just his opinion.

I don't think you have a very sound grasp of the nature of the internet or the military.

Collarme is also privately owned but I bet a year's worth of pay that if I wrote something on here, threatening the President, I would get a visit.

If I was a soldier, and displaying my identity in any way, shape or form, anything I wrote on here could be used against me and my career. Especially if it was a negative statement directed towards the leadership I was sworn to honour and serve under. If I was a smart soldier I wouldn't even create a profile on here, showing my identity as a soldier in the armed forces.
