My point is why wasn't Ginsburg, Breyer, Sotomayor, or Kagan the 5th vote? Did the others somehow vote "before" Roberts? Is there a roll call vote? Why wasn't Ginsburg's the 5th vote?

I thought I just answered that.

If the earlier votes, due to the partisan divide in the court, are essentially taken for granted, the swing votes are the ones needed for 5, hence, the 5th vote. It's a tally consideration, not a chronological series of Ayes and Nays.

I think Roberts is being paid by Mitt to take the heat of his utter lack of competence. Giving him a boost because he sure as hell couldnt win on his platform, competence or ability.
