You may want to consider that many surveillance systems are not private. The keylog and video files are sent to a server operated by the company who sold you the software, whereupon you can then access them. There can be no assurance that the company does not monitor or retain copies in case of criminal activity or court order.

I believe you are very likely to need legal advice if your relationship goes sour and you have assets.
