I do believe it's State Law that requires auto insurance. But, more importantly: 1. If I do not have a Driver's License or vehicle, I do not have to have auto insurance. 2. My auto insurance rates will reflect the risk of payout I present the insurance company 3. Previous history of payouts (similar to pre-existing conditions) will result in a higher premium (which isn't allowed under Obamacare)
