Apparently there's more...

It seems that back in 2002 the city of Houston was rocked by a series of devastating allegations about the work of the Houston Police Department crime lab.

Here is one of the articles of the time from the Houston Chronicle.

Here is part of the HPDlabinvestigation website which is the office of the Independent Investigator into the allegations.

James Bolding would turn out to be the central figure in the scandal. It was the same James Bolding that fabricated evidence of Mr. Hughes guilt and withheld actual evidence of his innocence.

The results of the investigation cast serious doubt on the quality of the convictions in which the HPD crime lab serology section had been involved. In 21% of the 850 cases where the defendant was still incarcerated, the investigators "found major issues calling into question the reliability of the serology work performed by the Crime Lab or the accuracy of the results it reported". In 41% of the 29 cases in which the defendant had already been executed, the investigators found similar "major issues".



Many of the city's officials have questioned how many wrongful convictions may have been obtained based on flawed forensic evidence and its presentation to Harris County juries.

Harris County is one of the leading counties for seeking the death penalty in the United States.

Preston Hughes' case has spent five years on a list of affected cases which should be reviewed from start to finish.

The Texas Court of Criminal Appeals has rejected a motion of habeus corpus filed by Mr. McCann on behalf of Preston Hughes.

I rather think that it's not the 6th which is most telling about the state of things in the United States right now, but what takes place on the 15th.

I don't want to go down that avenue of the color of one's skin because this has been discussed so many times before.

But what about the 'content of character'?

You have spent months, months on these very boards, arguing right and left, back and forth, about America, Americans, and the future with President Obama and the future with a President Romney.

Go take a look out of your window, step outside your front door. What do you see?

Surely you don't just see rock and concrete, what is outside isn't just an extension of you. It's a country, it stands for something. If it didn't, then why bother going out to vote or caring who won the election to preside over you all in the White House?

Where do you stand when it comes to truth? Justice? The value of a single, individual human being?

Is it acceptable for you for the authorities to make up lies to condemn an innocent man to death and then without any further consideration calmly execute him on the due date?

What do you stand for? And what is the world going to see that you stand for on November 15?

yep...there's plenty of white-on-white crime that's largely ignored. kind of annoying, but not surprising.

If it makes you feel any better, I think there should be a time limit imposed. If someone cannot prove their innocence in a few years time, then they should go directly to the chair (gas chamber, etc.).

I kind of like 2 years, but I would be fine with 5 years. Anything after that is a travesty of justice. There is no point to a death penalty if you give convicts endless appeals and wind up imprisoning them for life. On a semi-related note, I think any crime that currently carries a penalty of more than 20 mandatory years in prison should automatically be converted to the death penalty and follow the same restrictions just because incarceration is such a costly and ineffective punishment. If incarceration were effective, we would not have had to pass a 3-strikes law. Obviously prison does not work.

Nothing cures recidivism as effectively as death.

Have you read our Constitution lately? Might I suggest you do so.

If you and other conservatives want to start a Constitutional amendment process to change the Constitution to allow what you suggest, be my guest. That ought to keep all of you busy for a while....a long while....[8|]

There is nothing unconstitutional about that line of thought. The death penalty is not unconstitutional. The Constitution does not concern itself with how a court can legally use the death penalty, only with how it cannot be implemented (cruel and unusual punishment).

You're using an interpretation of the Constitution. The one you happen to like. It is not the only one.

Sadly, he will likely be put to death Thursday.

The death penalty has little place in modern society and the time it takes to administer the ultimate penalty is abhorrent.

The mere fact that the interview wasn't recorded would be enough to fuck up the prosecution's case here, Polite, never mind the rest of the catalogue. This sounds like an absolute shambles. Still, this is Texas, and people will want proper Christian feelings of love to be shown by killing people on a regular basis.

It sounds like he should have gotten a new lawyer a while ago. But he is in Texas so I am not sure how much good it would have done. I doubt Obama will get involved or he already would have.

stella...if the girl died within 90 seconds then why was she alive when arriving at the hospital?

Below is a report from the Houston Chronicle on 9/28/1988

The boy, who lived at 2607 Riverside, was pronounced dead at the scene. Charles, an eighth-grade student at Paul Revere Middle School, was taken to West Houston Hospital and transferred to Ben Taub Hospital, where she died shortly after arriving.

stella it also turns out a second witness found her alive after the attack then called the police...so beside the police another witness found her alive...amazing how the ....."amateur investigators story falls apart" 90 seconds my ass.

The autopsy also says the arteries mentioned were transected not severed. The depth of the slices would make a difference in the speed of blood loss and her ability to name her attacker…don’t you think?

Please go back and re-read the Constitution. I'm not talking about the death penalty. The issue is due process.

Presumption of innocence is a due process requirement and due process is part of the 5th Amendment of the Bill of Rights. A criminal defendant is not required to prove their innocence. The government must prove their guilt. Due process also means the criminal defendant in a capital case is entitled to exhaust all possible appeals regardless of how long those appeals might take.

You would need a constitutional amendment to revise due process and enable the courts to send someone to the death chamber after a few years if the appeals process is not yet complete. Otherwise such a law would be a violation of the Constitution.

Just citing facts here.

stella you said he maintained his innocence yet in his appeal there is this:

(1) a uniquely severe permanent handicap with which the defendant was burdened through no fault of his own and (2) that the criminal act was attributable to this severe permanent condition.

The appeals court disagreed.

So he was admitting the act in his appeal and saying he should not be held accountable because of his handicap.

Doesn't sound like he was denying the murders to me...how about you?

I see nothing wrong with life imprisonment for serious crimes (rather than the death penalty). Loss of freedom over an entire lifetime actually seems to me a greater punishment than death.
