In the 53.2% of incidents involving threat or attack, the offender initiated the threat or use of force in 83.5% of cases. Additionally, relevant to limits on magazine capacity, 52.8% of incidents involved more than one offender. Armed defenders fired in 23.9% of incidents, including warning shots, and fired for effect in 15.6% of incidents, wounding or killing the offender in 8.3% of incidents, for a hit rate of 53%. At this point, of course, we are down to only a small percentage of the sample so the statistics don't rise to significance. But a review of fifteen different studies found that police "inflicted at least one gunshot wound on at least one adversary in 37% of the incidents in which they intentionally fired at someone," and we know where some of those misses went.
The shooting outside the Empire State Building on Friday took a new turn Saturday: New York City Police Commissioner Raymond Kelly says all nine bystanders wounded in the deadly incident were "struck either by fragments or bullets fired by the police." ~NPR
