When does a marriage end?

Does it take a court of law?

I recently came across a forum post offering the opinion that the moment
she quits sucking cock, that's an unofficial, but very binding, divorce.

LoL....not sure I agree, but that amused me.

I would be VERY interested to see legal precident on this. While I'm sure there are men that would be disappointed or consider the death of BJ's a negative turning point, it is not in any legal sense a divorce

kiwisub12 -> RE: Very Disappointed Day (2/14/2013 4:24:07 PM)

my marriage pretty much finished when i realised that he only touched me when he wanted sex.

and i really do mean "only".

Needless to say, it really didn't get me in the mood. [8|]

All law derives from Common Law, and Common Law is simply what the "reasonable person" considers Just.

Given that, I'm confident a strong case could be made.

After all, we commonly award monetary damages in accident cases to spouses who have been denied
the consolation of sex due to the culpable party's malfeasance.

And yeah, I got my law degree by mailing in boxtops.

Just playing with ideas here.

Well. That's a damn shame. I'm sure it was difficult for
both of you. I trust you'll both see happier days in future.

Incorrect, but it makes as much sense as the rest of this thread.

LadyPact -> RE: Very Disappointed Day (2/14/2013 4:40:08 PM)

Really? Because she quits sucking cock?

Tell Me you are a better, less selfish man that that.

Seriously. that's your basis for the end of a marriage?

Christ! Thank the heavens that My men understand that sexual gratification isn't the end all/be all of life.

In My experience, men who treat the woman well don't have this issue.

I would like to thank you, greatly, for reminding Me, yet again, what the definition of a *good* man really is.

A marriage ends when one person stops trying.

Holy shit, this. Let me go tell my hubby right now how much I love him!

THIS.
I love sex.
I love foreplay.
However, THAT doesn't define my relationships.

I'm with LP thanks for reminding me blatantly what is NOT a "good" man and what is.

Those aren't very good ideas. All law is not derived from the common law, and even if it were, the common law is not simply what the reasonable person considers just. Law is derived from a number of sources, particularly in the modern world, where many, many pieces of the law have been codified. The common law doesn't simply look at a situation and say, "What would the reasonable person think is fair here?" Instead, it's based on an attempt to find what actually is just, which sometimes means applying the reasonable person standard.

So no, there's no case that could be made that the woman was at fault in refusing to perform oral sex on her husband (or even the other way around). If it was that big of a deal to him, he could make a claim of incompatibility, but that's it.

The type of claims you reference are what are known as "loss of consortium" claims. And it's not just the loss of sexual intimacy that's taken into account, it's the lack of physical intimacy, the inability to participate in the household, possibly the lack of ability to be emotionally close, the inability to communicate with each other.

I got my law degree by sitting in classrooms and putting in 80- to 90-hour weeks for three years.

Actually, there's a heartbreaking period during which one partner tries to keep it going all by himself/herself before it officially ends.

I wondered about this - as my situation is just the opposite.

If memory serves this is usually the charge leveled on a mistress (especially in the south). A certain country singer is being sued for financial damages under this
Gotta love the "she stole my man defense"

Baroana -> RE: Very Disappointed Day (2/14/2013 6:06:23 PM)

No, it's for personal injury cases.

Yeah funny. Not all wives/women suck cock you know. Twenty years ago the practice wasn't so commonplace. I'm old enough to remember when it was something only "low" women were willing to do. The so-called "safe sex"/"absinance" movements 1990's to present day are what increased its occurance because people looked for alternatives to having actual intercourse.

Lack of it has never been a problem in My marriage, 27 years this summer.

I personally consider a man homosexual/Bi if he doesn't prefer VAGINA over everything else. My Bi male friends say "men are better at giving BJ's than women" anyhow, so when a man says it's a REQUIREMENT, I usually encourage him to meet THEM.

Pretty sad if a woman (or man) feels she MUST perform oral in order to attract or keep a man, and pretty uncaring/pathetic of a mate to make it a requirement. Seems that *THERE* is where grounds for divorce would be.

Don't make the wrong things important.

Baroana -> RE: Very Disappointed Day (2/14/2013 6:26:12 PM)

Not commonplace is an understatement. Until 2003, the act was illegal in some states.

does this mean you only touched your spouse when you DIDN'T want sex? *scratches head*
