Abstract
International human rights law abhors a legal black hole. It applies wherever a State exercises its jurisdiction, not only in peacetime but also during armed conflict, as a compliment to humanitarian law. The deprivation of liberty is subject to certain conditions, and even initially lawful detention becomes arbitrary and contrary to law if it is not subject to periodic review. Indefinite detention is incompatible with Article 9 of the International Covenant on Civil and Political Rights. While temporary derogation from this provision is allowed in Article 4 of the ICCPR, such derogation is only possible “in time of public emergency which threatens the life of the nation” and “to the extent strictly required by the exigencies of the situation.” Persons deprived of their liberty are entitled to a prompt trial or release, and in cases of arbitrary detention, they are entitled to compensation. Neither the war on terror nor restrictive immigration policies justify indefinite detention.

That is old news..

I believe it was in Dec 2011 Obama backed down & removed American citizens from being put into indefinate detention.. ya know, cuz the election was not that far away and he wanted to be re-elected .. so he softened his stand on only Americans to get and keep votes.. and as far as I know so far that has not changed.. right now its just people like me that are not American citizens that can be thrown into a US jail and forgotten about.. I do expect at some point the govt will quietly add Americans to the list that they can do that to..

those vids are from 2009.. voters still voted Obama back in now didnt they?..

If the government creates a "legal regime" that can pigeon hole americans as enemies of the state or a threat to the security of the state under any conditions, how can it be said the state is of the people? logical falacy

But precrime?

the incremental chiseling away at the rule of law by degree destroys countless lives and liberty of the vigilant few initially and eventually everyone.

The news might be old but the problems it creates are growing.

your error is thinking that it makes a difference who the Prez is or even which party is in power, they are all 1%ers and will continue to support the 1% in all respects.. the govt considered OWS protesters to be "domestic terrorists" and "criminals" just cuz they attempted to exercise their supposed right to free speech.. Anyone that believes the state if for the people is a fool.. but there is a lot of those and oddly enough they think their vote actually means something..

so the real question is.. what are you actually going to do about it?

It is also cute how ignorant humans are. However, that wears off when you realize you have to share the planet & good air our kids could use with them. Obama changed nothing with the NDAA relevant to US citizens.

The NDAA is actually online - LOL? You can read it too, if you know how to do that. I get it media said a lot of things at that time. As I said, you can go read it. There is no argument or debate here. It is just really odd.

Well when you have a government that is constantly chiseling away at the rights of the "common" people, a government that is is believed to be chartered to protect those rights in fact are morphing them over time to work against the common people in favor of government, with ongoing and growing impunity, at some point it begs the question just who "we the people" are and if the ordinary commoner controls anything outside of choosing new rulers.

Now that may sound funny but its a fact that the government cannot prove the the common people voted for these constitutions, and neither can they prove the way in which they vote on any issue today is supported by constituents.

How can this be a government of the common people if there is no voting records or constituent write in records? Hell they cannot even prove they are bonafide states except by agreements made between the states outside the purview of the common people!

I think the most important question is "what if anything can be done" about it.

One of the complaints of the so called founders and support of the independent government was lack of redress. That is the core reason for their uprising.

When political rights, free speech, and liberties have become extinct to the point that the OWS are determined to be terrorists with no redress it begs the question who is being terrorized by who?

The question is what options are available at this stage?
