The man convicted of murdering this woman's husband nearly 18 years ago is now sueing her and 4 others for emotional distress and invasion of privacy.Why...because they told the court the murderer should not be allowed to serve his 31 year sentence in Canada where he was born.[sm=banghead.gif]

Just because he filed a suit, doesn't mean the court will hear it.

I could file a suit against you on Monday, it's my legal right to do so. Of course, it would be dismissed by barely more than a request from you, and in all likelihood this will as well. In the meantime, it makes news.

He's got plenty of time to try to learn the law. As LL said, it'll likely get dismissed.

a very minor cavil I know, but it actually is a constitutional right, from which laws are based...the old petition for the right to a redress of grievances clause...

And they can be petitioned, but it doesn't say that they will be given fair hearing in any case.

To add to what was said above, the family could file a counter suit claiming damages from the filing of a frivolous lawsuit. Unfortunately, the guy is in prison and they will gain nothing by winning such a counter suit.

As was said also above, he has plenty of time on his hands to learn the legal system and to learn how to manipulate it so that he can be harassing while in prison. If he continues, she will eventualy be able to file a complaint for harassment to get such actions stopped. What's more, she can bring this issue up at every parole board hearing the guy attends as evidence of his failure to reform and that he continues to harass his victims from prison.
