Picture takers and gawkers should be rewarded with harsh sentences.

Agreed. All the onlookers should be charged with accessory to the crime, and do some prison time.

The problem is, it's not against the law to ignore something bad happening. A private citizen has no legal obligation to intervene. Actually, considering how litigious society has become, often all intervening gets you is sued. Or you run the risk or the pack turning on you.

All someone had to do was call the police. I doubt there is much chance of getting sued for that. And while there is no legal obligation, there is a moral one. At least as far as I am concerned. Decent people don't stand around and watch this kind of shit. Now having them put to death seems a bit extreme to me, but I would love to see them punished in some way.

I don't disagree. Personally I think someone who could stand there and watch a woman be raped and/or murdered is a complete scum bag. That is however a moral argument. From a purely legal standpoint, you can't prosecute someone for not getting involved. I don't know if someone could be prosecuted for egging them on. I don't think so, but perhaps a case could be made.

I also didn't think about just calling the police, shows where my head is at I guess.

Actually, some can be prosecuted for doing nothing. Mandatory reporters. The participants that night did not fall under that classification.

Or even notify the on-site security.

Of course they have... lol... and each one has gotten worse.

Nah,we are just so wired in to everything that all of these sordid stories are no further than our keyboards.

This I agree with....but I do wonder how these "viewers" can live with themselves as time goes on

I suggest that we skip the trial, and place the people who committed the crime and those that watched the crime happen on a nice, tropical island, like the one in a sci fi movie I saw, cant remember the name, but convicts were placed on an island and left to survive by their own devices. Now granted, I would populate the island with large predatory cats and put salt water crocs in the streams and such.....

Don't be silly; abusive parents should be dealt with (removed from the home, imprisoned, whatever, as appropriate).

BUT. Two parents, one of which is male, one of which is female, who are married to each other, and who each provide loving care for the little monsters is the best scenario; whether or not two promiscuous gay men who are good to/for children are better than a married hetero couple, both of whom are brutal meth addicts, one of whom is a child molester.

You're proving my premise. As a (liberal) society, we refuse to uphold ideals, refuse to say that some things are just better.

truckinslave -> RE: California rape case begins (6/10/2013 6:10:00 AM)

What you said.
All of it.

truckinslave -> RE: California rape case begins (6/10/2013 6:11:27 AM)

Lord of the Flies?

Well.. duh... no one said it wasnt.

No, what I refuse to say is that YOUR ideals are just better. You dont get to pick and choose what is best for society.

As much as that sucks.... thats just how society is. Else women would still be waiting to fuck until they were married, men would still be walking around with hard on's all the time, and children would all be like that little fucker Timmy who couldnt keep his own ass out of wells.

Yet you cannot make yourself say that it is, either; and prove it again in your next sentence.
You have now so sufficiently, and sufficiently eloquently, demonstrated my point that I shall now consider the matter moot.
Thank you.

There are no absolutes in this world. There is no absolute proof that a two person family is better than one. There is no absolute proof that the "loving" family unit you described isnt abusive. There is no absolute proof that a single parent cant raise a child just as effectively as two...

In other words.... even with all the psycho babble behind you.... its still just an opinion.

One along the lines with the "curtain climber" generation.

I have issues with the defense attorney's "beliefs" about how his client's dna ended up on a used condom found at the scene. But, its an attempt at a defense.

Don't judge a defense attorney by his arguments on behalf of a client. We sometimes have to do terrible things because we have an ethical duty to our clients. While the case here in Ohio was going on, I was talking about it with somebody from CM, and I said that if I was defending an accused rapist, and the facts were such that "blame the victim" was an argument that might get some play with the jury, I would do it...then I'd go home and cry about having done it. I'd probably write a letter to the victim apologizing after everything was done, too.

Doesn't a defense lawyer have the right to decline a case?

Privately retained attorneys do, yes. If the attorney is court-appointed, then they can only be excused if they have a good reason (conflict of interest, lack of time, etc.).
