This story is kinda local to me and I have been hearing about it for quite a while now..I am so glad it all worked out well for him..but no one can take away the time he spent in prison....at least he can still follow his dreams and the mistake was found out sooner rather than later! Nothing is 100% perfect..especially our legal system...but I do agree this woman should be punished in some way..jail time for sure!

It ruined his pro football shot.
She should (although I know the law won't provide for this ) the same amount of prison time he got.

Or he should be given "total" access to her for , say 6 months (law won't allow that either.

Except that women are banking on the system not doing anything to them... there is no deterrence ....

A rapist is a slug

A woman who accuses a man of rape in a fit of anger, spite, jealousy, ect ect ect, is lower than a slug.

It wasnt found out by mistake, she came forward and recanted... after he was out of prison.

according to the article:
"He served five years in prison and another five years on probation as a result of the original verdict, and was released only in 2012 when Banks taped her admitting that the accusation was false."

that makes it sound like he was still in jail? and somehow he taped her confession?

yes, 5 years in prison, then after he got out, 5 years on parole....

http://www.cotwa.info/2012/06/bygones-be-bygones-unspeakable.html

This case had many victims, not just Brian, though he paid with his pending career... his mother had to sell their home to afford his defense. Faced with 41 years to life, he took a plea deal. They were lied too by everyone, the girl, his attorney, the police... the cards were definitely stacked against this kid.

This all happened in 2002... he plead guilty a year later. In 2012 she admitted to the lie. Which means the statute of limitations (4 years) is still in play.

Its heart breaking that because of consensual sex, this young, bright kid lost his future...almost.... thankfully he had a PI who was willing to help.

No and no.

We dont do vigilante justice. I remember someone on another message board suggesting she should be raped... and I was horrified. Rape as a court sanctioned punishment?

The charge results in a misdemeanor, if I recall correctly. It should be a felony. Its time women, and men, started speaking up about rape. Its also time that the games of "I will cry rape if ..." ended completely.

with what that article says, she was lying and it was obvious, no evidence in the rape kit so the case should never have gone anywhere, let alone a conviction and jail.. the cops are just as much if not more responsible, imo, cuz they know better (than a 15 yo dumb kid).. and to top it off the girl wanted to tell the truth and was told to shut up by her lawyer (who got paid $750,000 for subverting justice), he is even more responsible cuz she confessed to him the truth.. Imo, if he should sue anyone it should be the cops and her lawyer..

He seems to have an amazing amount of inner strength, I hope he does do great things with his life..

I specifically stated that the law would not allow it, of course we can't go down that road. and I agree that the actual solution is yours make this a felony so that she pays the kind of price for her crime that he did for being her victim, let the punishment fit the crime.

Sounds like several people should be behind bars.

Good news is he has his chance with the Atlanta Falcons.

Bad news is, this false reporting isnt going away.

But he lost what would have been his best playing years.
But you are right the law needs to be changed.
If tj444 was correct she could and should be charged with perjury.
It would seem that that option should always be available in these cases.

He is 27. He would not have graduated college until he was 21/22. I think saying his best football years are behind him is a bit pessimistic.

Miles Burris is 24
Manny Lawson 28
Akeem Jordan 27
Sean Weatherspoon 25

He has to make up some loss time sure.... but what is fabulous is his life isnt completely derailed by this "bitch".

I dont often talk badly about women, but in this case, there is nothing good to say about her. And while I rode naughtynikki hard about his misogynistic views, he had some good points to make, once you got him to calm down long enough for him to think rationally instead of emotionally.
