WASHINGTON (AP) — A sharply divided Supreme Court on Monday decided to make it harder for Americans to sue businesses for retaliation and discrimination, leading a justice to call for Congress to overturn the court's actions.

The court's conservatives, in two 5-4 decisions, ruled that a person must be able to hire and fire someone to be considered a supervisor in discrimination lawsuits, making it harder to blame a business for a co-worker's racism or sexism. The court then decided to limit how juries can decide retaliation lawsuits, saying victims must prove employers would not have taken action against them but for their intention to retaliate.

Justice Ruth Bader Ginsburg wrote both dissents for the court's liberal wing, and in a rare move, read them aloud in the courtroom. She said the high court had "corralled Title VII," a law designed to stop discrimination in the nation's workplaces.

"Both decisions dilute the strength of Title VII in ways Congress could not have intended," said Ginsburg, who then called on Congress to change the law to overturn the court.

Its amazing how rabidly left wing this board is.

Yeah cutting down on lawsuits is a bad thing. Like we already don't have more lawsuits than any other country on earth. Or more than 20 times the concentration of lawyers (per capita) of any other country on the planet.

[sarcasm] yeah, if a company doens't want you to work there, you should sue. Lets make everything the purview of lawyers. Lets let the government decide EVERYTHING.

Absolutely, as discrimination can only be by one so able to do so. A co-worker might run afoul of policy, but policy itself does not necessarily confer a discriminatory nature.

Do they? Or is that, to Ms. Ginsburg, Title VII is being disallowed, by the majority opinion, expansion beyond its intended reach? To me it would appear so, as she calls on Congress to expand its intent.

I find it amazing that people will sue companies over hot coffee spilling in their crotch from a Styrofoam cup at McDonald's, that clearly there was a lawsuit that forced the warning labels for not using a blow dryer in the shower when the water is on, and that a superman costume does give the wearer the ability to fly

It'll never get changed...and thank gawd....it's about time small business isn't held hostage to an ex employee's interpretation of why they suck at their job.
