The same sex marriage ban in California was passed by the majority of the people. It was the losers of that vote that went crying to the judge to have the law struck down against the will of the people. Ever since the vote, the majority of Californians are bigots because they disagree with the whining minority of Californians. If you want to talk about sour grapes, there's your sour grapes.

Maybe you're unclear that the courts exist to protect the rights of minority groups. Just because you can get the majority to vote to take away some small groups rights doesn't make it constitutional.

And in this case we're talking about the groups that had their day in court and their defense of this law were best described as laughable and now they're whining over the appellate court lifting the stay on the original trial court's order 3 weeks early. They already lost at every court at every level in both the state of California and the federal system and they aren't going to come up with some novel way of convincing a majority of SCOTUS that they have standing and much less prevail on the constitutional issues.

As social conservatism becomes progressively more of a minority position you may want to refrain from advertising that the majority should run roughshod over the minority. I mean besides that the founding fathers had a good deal of contempt for that system and set up checks and balances to try and prevent it. It just isn't a good plan for you.

The passage of Prop 8 was a fluke. The law was wrong, and discriminatory, and I'm glad it has been struck down.

The respondents, ie the prop 8 supporters, have 25 days to request a rehearing. However the ruling of no standing has to be over come and SCOTUS found that they would not be damaged in any way by prop 8 being over turned so they would have to prove to the court that there was some tangible harm done to them by that which I cannot see happening.

The vote to define marriage in California as being between a man and a woman passed. I think you are the one who is woefully uninformed if you believe otherwise.

As opposed to the fuckwits who rallied, raised money to fight the bill before it was voted on, failed to gain enough support to stop the bill from becoming law, then went crying to a judge after they lost? Gays had every opportunity to win that fight, and they almost did. The sad simple truth is that instead of accepting defeat at the voting booth like adults, they decided to enter into a campaign of namecalling and used the courts to force their beliefs on everyone who voted against them.

Since the gay lobby is actually imposing their beliefs on everyone in California, calling everyone who disagrees with them names to try to gain some political validation really just makes my point for for me.

But there is this

So since prop 8 allows some people to marry and not others it violates the 14th Amendment. Just like Virginia violated the 14th in 1967 when SCOTUS ruled in Loving v Virginia.

BTW the reason the prop 8 groups are called bigots is because when called upon to support their claims in a court of law they brought totally disproven crap and hateful nonsense equating homosexuals with pedophiles and zoophiles. And that is not my opinion, it is the opinion of every judge at every level that heard this case and its appeals except the Supreme Court which avoiding issuing an opinion.

I have no issue with it being overturned, but its a bit hypocritical for people to be yelling about how we have to follow the law... except that one.

(a) The Supreme Court took a different view in its unanimous ruling in Loving v. Virginia, which struck down laws against interracial marriage: Marriage is one of the "basic civil rights of man," fundamental to our very existence and survival. Skinner v. Oklahoma, 316 U.S. 535, 541 (1942). See also Maynard v. Hill, 125 U.S. 190 (1888). To deny this fundamental freedom on so unsupportable a basis as the racial classifications embodied in these statutes, classifications so directly subversive of the principle of equality at the heart of the Fourteenth Amendment, is surely to deprive all the State's citizens of liberty without due process of law. The Fourteenth Amendment requires that the freedom of choice to marry not be restricted by invidious racial discriminations. Under our Constitution, the freedom to marry, or not marry, a person of another race resides with the individual, and cannot be infringed by the State.

(b) Wouldn't the Ninth Amendment--The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.--also cover marriage?

There is no law. It is court procedure. The losing party has, I think, 30 days to request a rehearing which are almost never granted. It also takes several weeks for the court to publish its opinion officially and transmit what ever orders result to the lower courts affected.

In this case the California Attorney General requested the appellate court lift the stay it had placed on its own decision on the case. Normally they wait through the formalities but it is not required.
