Barnett said her key no longer worked and she had to climb through the window to get inside, where she discovered that many of her possessions had been hauled away.

According to Barnett, she presented the bank’s president with an $18,000 estimate to replace the lost items, but he refused to pay.

“He got very firm with me and said, ‘We’re not paying you retail here, that’s just the way it is,’ ” she recalled. “I did not tell them to come in my house and make me an offer. They took my stuff and I want it back.”

No one from the bank would go on camera with 10TV News, but a vice president told the network that they are trying to “come to terms” with Barnett and “hope to have things resolved very soon.” However, Barnett denies this.

“They make it sound like I’m trying to rip off the bank,” said Barnett. “All I want is my stuff back.”



There's definitely one line missing (I know because it's my favorite line). It comes right after the bank refuses to "pay retail" The lady says: "I'm not running a yard sale, here" and then, the given quote.

HAHAH reminds me of once I bought a car and traded in this beat to death price of crap 68 VW BUG I had, that didn't run

I gave them the address to where to pick it up and they came to my house instread and took some other guys VW

when I called em and asked why they haden't picked it up yet they said "we already have it!" gave me the address where they picked it up from and I told them, I don't know who's car that was, but the one I gave you the title to is still sitting right where I told you to pick it up from!

Got to wonder why the bank is not being prosecuted for B$E and grand theft? Also why doesn't this woman have a lawyer? Any half assed attorney would win this civil suit and with the way people feel about banks I doubt she'd only get 18k from the suit.

Also doesn't the Sheriff's department, or the equivalent, do the evictions in Ohio? Surely they would check the address on the order before they started emptying the house.

They couldn't. They didn't have title. They broke into the wrong house. The house they own is apparently across the street from hers.

They couldn't. They didn't have title. They broke into the wrong house. The house they own is apparently across the street from hers.

I have heard of banks selling the wrong property before..

When it comes to banks or mortgage companies, anything is possible! I was under contract to buy a certain property but when the title company did its search they found out there was no order to foreclose (or whatever its called) filed with the court.. The realtor basically told me it was no big deal cuz the property was in the mortgage corps name.. yeah.. no big deal..

I can't help but wonder....don't the dumb fucks from the bank look at the house numbers?? I mean, to just rely on GPS and unmowed lawn? Seriously??

I agree. I so wouldn't settle for anything less than an outrageous fee. And I'd criminally prosecute to the fullest extent of the law.
Cuz I somehow don't think a jury is gonna have much sympathy for any bank at this point.
Take it to court, you might just cream the bank hard. The lawsuit equivalent of a Peter North money shot.
Fuck, now that would be some justice

I was kinda wondering the same thing. I'd call it a no-brainer but that seems to be exactly what happened...no brains.

You know I completely agree with you. 9shoot me lol) They should be payinbg millions for Grandma's baby pictures from the old country and everything imaginable.

But you now what ? Because of the system that people like you support that will not happen. They could drag it through fifty courts and be lucky to get the eighteen grand. Know why ? Because corporations are people now and apparently people are not.

Watch this case Ken. You are a decent watcher. Watch how it will disappear off the RADAR screen so that people forget it and then there will be the media unsupported voice of one little people in some obscure state we will not even remember left with probably less than the paltry eighteen grand for their possesions, simply because the banks have more money for lawyers.

I now how it works FIRST HAND. Without money the system doesn't work. That is what Burt told me, the best layer I ever had. I had four first offences. I am telling you now, money talks and bullshit walks, and though we both may be outraged about this now, we will forget soon enough.

If we do not they will come up with another scandal. Mark my words, enemy/friend.

Agreed.

B&E and theft are criminal offenses, not civil ones. The woman needs to report the break-in to the cops, and I suspect she hasn't, for reasons that elude me.

ATTORNEY TIME!!

I am very glad I don't bank there, or at least I hope not LOL. Now that is just crazy, and a bit funny if you are not her. If its all true, she could really clean up on that one.

The first thing she did was report a break-in to the police but, they decided that since it was a "repo man" there was no criminality; which reaks of bullshit to me.

The fact that there have been no criminal charges (even if just "for show" to get the repo man to roll on the bank) is very telling in two ways:

1) A crime was committed. While there are mitigating circumstances, a crime was committed. Does anyone remember the month or so before Zimmerman was charged?

2) That the police said: "Oh, yes. A guy who is allowed to legally burgle certain houses accidentally burgled yours so, we see it as a no harm-no foul kind of thing" is bullshit of the first order. Someone needs to get this lady's stuff back or pay to replace it. I doubt they were able to sell the stuff with emotional meaning for her so, it probably got tossed.

The "repo man" was acting as an agent of the bank. I want the head of the bank charged with B & E, unlawful entry/trespass and grand theft. What ever happened to the rule of law?

I would interpret it not as criminal but ONE HUGE MISTAKE. The fact remains, they not only disrupted this womans life to the full extent, they got rid of her things, probably things in there that meant a lot to her. They owe her big time.

Oh I thought you all were talking about the bank repossessing the wrong house, not a drunk woman. That's a lot different then what I was reading.

After thinking about it proving B&E or theft might be difficult since those crimes do require intent and that is missing in this case. Although the civil tort should be a big winner. I cannot believe the banks insurance provider would want this case anywhere near a jury.
