Well, I did bankruptcy in 2010 and I decided to use a lawyer. Maybe your situation is different but I wanted one. I thought it worth the money. Fifty grand scot free, it was kinda worth it. Did you do the phone school thing yet ? I actually won that one too, I got it for free.

Whatever you do, when they get you in there make sure not to even make a mistake, llet alone lie about anything (that they can check). Are you telling them about the metal ? If you didn't buy it in the back of a bar for cash, or you have a rider on your insurance for it you better tell them or they will male for a very unpleasant experience. I would say they'll fuck you in the ass but .........

Just make sure to be straight with them about anything that ever had a piece of paper or electronic communication attached to it.

Incidentally, no lawyer means maybe nobody told you : Do not discuss anything with any bill collectors if they call. Do not respond to any offers of reconciliation from anyone, even your mortgage company. Whoever calls, you cannot discuss it for legal reasons and that is all you can say.

Some of the sharper ones may ask if you have filed bankrupcty to pump you for info, do not fall for it. You can tell them that you filed, but give no other information. Tell them that they will get the proper notification just like anyone else.

If the mortgage (unlikely) company calls you and asks if you intend to reaffirm you cannot answer at this time, but if they would like to leave their specific contact number you will call them as soon as you know something.

Unless you told them something, you mortgage company only rechecks your credit a couple times a year. If it does occur, they may call.

Under no circumstances even charge a loaf of bread....

Speaking as someone that works for a bankruptcy law firm on behalf of creditors and has personally monitored thousands of cases: Get a lawyer. Get one now. Quite a few of them will handle a BK on a fixed fee basis. Very very few Pro Se defendants make it through to discharge (the point where liability for eligible debts are removed). Most Pro Se defendants get their cases thrown out because they either didn't file all the needed paperwork, or they filed the paperwork incorrectly, or they fail to follow up with some filing in a timely manner. If you were struggling with the paperwork just to file, you are almost certainly not going to make it on your own.

Got to agree with Carpe Coma..my career has been working in lending & credit..and the process for Bk is not simple example-many people don't realize the government considers everything an asset & expects you to list it-the suit in your closet, the 4 Tshirts you received from Red Cross, the screwdriver, hammer, the pair of shoes that are too big that you never wear... If you fail to disclose all of your assets, even by mistake, it is construed as fraud.

I dont think you realize how broke I am.

Some months I am not sure I can even pay the mortgage.

I do not have $2000 laying around to file chapter 7.

They just called. They accepted my filing. She sounded helpful. There is just one form I did not include which she will send me.
