Judge tells living man that he’s still legally dead Life can be tough, especially when a judge says you’re dead in the eyes of the law. That’s exactly what happened to Ohio resident Donald Eugene Miller Jr. on Monday when a judge upheld a 1994 court ruling declaring the 61-year-old legally dead. The Courier reports that 19 years ago, a court in Hancock County declared Miller legally dead eight years after he disappeared from his rental home. As a result, Miller has lost his Social Security number and his driver’s license. Judge Allan Davis called it a "strange, strange situation," but he also said the court cannot budge in its decision. Source: Yahoo! News Just when you think the world can't get any weirder. I can't believe there's no recourse for him.

That a judge is so arrogant that any decision isn't revisited when new information is available is just one more indictment of our dysfunctional 'justice' system. The original court decision protects the good faith actions of others since then (Wife remarries, parental and inheritance rights for situations still to happen. . .) but can't change reality now that he is known to live. His SS earnings are still his, the drivers license would have expired anyway. His SS and DL #s are unique to the individual and shouldn't have been reassigned. Names are shared, the law clearly distinguishes between different bodies and persons with the same names. How his property is assigned ownership now is what lawyers get paid for? His motives or responsibility for 'disappearing' would have bearing.

I'm going to assume the guy left his home 19 years ago and just wanted to disappear. He probably took on a new name and I'm sure he had to be working somewhere. He would have needed ID and a social security number and such. So he probably has them under his assumed name now. Therefore, the judge is telling him he gave up his right to his name once he deliberately disappeared off the grid. And now, for some odd reason, he wants his old identification back. Just one more thing to think about and to make sure we can deal with the ramifications for those of us who want to do the disappearing trick someday.

The judge did him a favor. If he were legally alive, he would owe $26K to his ex, and she would need to repay the government $26K.

Anything in the law about what might define someone as being "alive"? If a judge doesn't know what to do, then how does someone go about proving they're alive? If it turns that Elvis has been alive for all these years, I hope he doesn't end up in this court.
