So in your view, she should receive a harsher consequence.

I'm not one who believes everyone should be able to carry a weapon "just because" and yes this one reason why.

Thank you for proving my point.
And yet you approve a much more lenient penalty than I do.
Is this because I expect more of a permit holder than you?

I don't know that I "approve" a more lenient penalty, rather I am speaking simply of waht the penalty she faces is, and it isn't a big deal.

Frankly, I'm willing to bet there is something in this woman's mental health status and history that should have deemed her ineligible for the permit. While I agree with the premise of a right to own a gun, I don't feel that many people should have them due to various reasons that would disqualify them. When it comes to a carry permit for handgguns, I believe in even stricter rules. In my opinion, the majority of people are not responsible enough to be toting a gun around and many do just because they were given a permit, rather than having a valid reason to do so.

Are you aware that in most places, Philadelphia being a notable exception, only 3-4% of people both want and are able to get carry permits.
I  know that the press would have you believe differently but passage of concealed carry does not result in every Tom Dick and Harry running around armed.
Those that do have a much lower crime rate than the general population.
The shootouts in the streets that is always predicted has NEVER happened.
People like this woman who misuse the right should forfeit it.

LafayetteLady -> RE: mother arrested for protecting daughter (11/3/2013 2:12:06 AM)

In NJ, yes it is very difficult to get a carry permit. In Florida, hower, its quite easy and yea, they do hand them out to every Tom, Dick and Harry.

I am aware of the crime statistics in areas where getting a permit is easier, as well as the "argument" that it is so because potential criminals don't like the idea of someone being able to shoot back.

I don't at all think that allowing people to carry a weapon is going to result is shoot outs on the street, nor have I ever indicated it. However, I still believe the majority of people (all people, not just people who have a permit) lack the responsibility that goes with being allowed to carrry a concealed weapon.

I am very open about my opinion that background checks need to be more detailed as well as being in favor of waiting periods. Realistically, someone who wants a gun right away is more than likely being impulsive. Collectors already have their permits, so they aren't affected.

I'm sure you can agree that acting impulsively (much as the woman in the OP) is not a positive trait when toting a gun.

You are wrong about states like Fl. You can't just walk in and get a permit.
There is in every state a minimum of a background check against the same database as is needed to obtain a firearm in the first place.  Think of your logic here.   We trust you to buy a gun, own a gun, and keep it loaded.  However we don't trust you to leave your house with it.  Alabama is a must issue state, that does not mean they have to give everyone a permit that wants one.  It means that the Sheriff's office must have a specific reason to deny one.  I used to work for the Sheriff's office and we turned down a bunch of them.

You have not made a point I said as soon as the truth was revealed that her permit should be revoked.

Then they lack the responsibility to drive a car.

LafayetteLady -> RE: mother arrested for protecting daughter (11/3/2013 2:23:23 PM)

And many do lack the responsibility to drive a car.

As for FL, I'm speaking from experience of knowing people who received those permits.. a background check needs to look for more than just a criminal record. I realize you probably disagree, but we are each entitled to our opinion.

I don't disagree the woman should lose her permit. My point is that she probably never should have received one in the first place.

I would guess that our disagreement comes from our view of what ownership and a carry permit are.
If a right the government needs to prove why and individual can't do something.
With a privilege the burden  is on individual to prove they need to.
What incident do you have personal knowledge of in this woman's past that should have disqualified her from having a permit?  I have seen nothing about her past but you must, being so sure there was reason to deny her permit in the first place.
