Our ex roommate and good friend just received a letter saying his driver's license has been suspended over child support. He is not a deadbeat dad that refuses to pay. His child support payments are deducted from his paychecks (like auto bill pay) and have been for years. A short time before he moved out, he broke his foot. He ended up needing surgery, had to use crutches, and was off work for a couple of months. He went back to work as soon as his doctor said he could and his paychecks resumed along with his child support payments. Now, a year and a half later, they decide to suspend his driver's license because he's behind on child support despite the fact that regular payments are being received. I thought this only happened to deadbeat dads. What can he do about this?

He SHOULD have contacted the courts and let them know about his injury and work issue. So now he's paying for that little mistake. All he can do now is contact the courts and claim his case. Doubt it will work though.

Lots of story's like this in every paper.

Amazingly few of them involve women who don't pay up.

I promise you - hell hath no fury like a WOMAN ordered to pay child support.

After reading all the other responses and what the op has said...

op, your friend is lying on soooo many different levels. I've sent out those letters to parents who didn't pay. You don't get just ONE letter. We sent them every two weeks and after 90 days, the DMV would be sent a list of those who did not pay up. Your friend is lying to you. And your friend can't just call up and fix everything over the phone. They would set up an appointment to meet with a mediator where arrangements would be made.

And personally I'm betting he's lying to you about why he was fired from his last job too. You know I've worked at some shitty jobs and not once was I ever fired no matter how bad the situation was. And even if he was fired for something he says wasn't his fault, he could have fought it for that reason.

I think you need new friends.

Most who cant afford child support also cant afford a car, so again whats the point??

Actually, that's incorrect and you're confusing "not able to afford" with "claiming to not be able to afford"

From what I'm seeing:

He called child services and told them...and I'm sure their response was "let us know when you're working again so we can deal with the payments you missed". Then he didn't contact them about the back payments. Then he ignored the letters. Now, he's playing the victim.

When he broke his foot and was out of work, did he call the court and explain there would be a problem making the payments? Because here in NY you can file a petition to reduce the payments if you are out of work....if you don't you still are responsible for the entire amount. I mean I understand that things happen, but think about the mother who depends on these payments and did not get anything for a couple months....sorry I am being harsh but my ex is that way...he never files to reduce the payments because he is lazy...he gets tired of paying quits his job works a temp job for a couple days so I get some payment like $20 then gets laid off from the temp job and draws unemployment...currently he is over 7 grand behind...and pays $20 a week on the back support...and once again...he isn't paying but thankfully...the order is now in his home state so...guess what if it goes one more week, I can violate him and he will go to jail since they already took his driver's license. Trust me it is not about the money...it's the principle. If he called me and said, "I'm sorry I broke my foot and can't work." I'd say, "File a petition to modify the payments." Just as I have in the past...as it stands now...he'll be filing Social Security before he pays it off...my daughter will be 21 soon and I doubt very much he will go to court and have the wkly payments stopped because he probably doesn't even remember his birthday.

On an aside: It doesn't make sense to me to suspend driving privileges for deadbeat dads. If they can't get to work they will fall even further into arrears.

I think it is a conditional suspension meaning they CAN drive to and from work and that's it.

I have to ask. How does getting wasted and breaking his foot on the train tracks make this "not his fault?"

I think your friend might need some help in the 'personal responsibility' area.

We told him we would pick him up if he needed a ride, then didn't answer the phone because the ringer was turned off. If we had picked him up, he wouldn't have broken his foot. This guy rarely gets wasted. He got drunk because he was written up at work over customers stealing gas. The stupid convenience store he works for refuses to make customers prepay, then blames the employees for gas and goes which usually happen when the store is busy. I don't know how they keep employees when they treat them like that. He's tried to find work elsewhere, but most places around here start new workers out part-time at first and he has to have full-time hours because of child support. He definitely should've followed up more with the child support folks though. Maybe this mess could've been avoided.

I don't mean to be harsh, but the accident is STILL HIS FAULT. Yes, I understand he had a bad day, and I can understand wanting to drink at the end of that. Doesn't make him a bad person. But, also doesn't absolve him of any responsibility of the aftermath of his choices. And yes, if you had followed thru with giving him a ride like you promised he wouldn't have been in the place where he hurt his foot. But, quite frankly, if he was so sh!t faced he hurt himself walking, he could have hurt himself walking from the car to your home (I've done it, and I was perfectly sober !).

My point in all this is how he hurt himself has absolutely no bearing on wether or not he should have been responsible to pay for the few months he was out of work. But it does show how completely unable he is to take personal responsibility for his actions.........

No, it's not a conditional suspension, or a limited one.

DommeinRochester -> RE: Driver's license suspended over child support! (11/11/2013 5:21:08 PM)

So we're supposed to feel bad about a guy who only supports his children when someone else is taking the money out of his pay?

Culdron -> RE: Driver's license suspended over child support! (11/12/2013 6:37:16 PM)

Support doesn't always end at 18, just FYI. Often it's graduation and if the kid goes to further their education it can go through those years as well.

xxblushesxx -> RE: Driver's license suspended over child support! (11/12/2013 11:17:48 PM)

It depends on the state. In NY it's 21.
