The storage tank wasn't part of EPA regulation because it's just a storage facility and not a production facility. The difference? I don't know. Personally, I'm surprised that a storage facility for chemicals that could be dangerous isn't open for inspection and regulation by the EPA. Regardless, the facility should have inspection processes to prevent this kind of thing. That there hasn't been any charges levied against Freedom Industries yet simply means that efforts are focusing on cleanup at the moment, not that there won't be any charges. I haven't read anything about exactly what happened, leading to the spill. That shows me that prosecutors aren't just knee-jerk reacting and will bring forward charges that will fit the "crime."
