Sorry, his protests don't make it sexual assualt. If it did, every incoming prisoner subjected to cavity searches could claim sexual assault. The police did have a warrant, but they also went way overboard in their search. I'm willing to bet that had he just been subjected to one x-ray, digital (finger) search and one enema, he wouldn't have won his suit. Because they continued with multiple enemas, whcih could have endangered his life, and the prep for colonoscopy, that is why he won the search. If they couldn't find drugs with and x-ray, finger search and one enema, they weren't going to find any. A HUGE portion og that settlement should be paid by the hospital because the staff had an ethical obligation to inform the officers that if those first three searches didn't. Find narcotics, nothing further would. The police are not trained medical professionals, the hospital staff is.
