I am very happy to hear this. This man was stripped of his civil rights, wrongfully detained, abused and sexually assaulted by the police and the hospital. He deserves every penny of this award.


A New Mexico driver who was forced to endure a series of humiliating medical procedures following a routine traffic stop has been awarded a settlement of $1.6 million. David Eckert, 54, was subjected to a 12-hour ordeal last January that involved repeated enemas and anal probes in a failed attempt to find illegal substances hidden in his anal cavity.

Every probe of the anus is not a sexual assault... Otherwise... his rights were ignored and I feel for the tax payers right along with the victim...heads should roll.

Every probe of the anus that the victim did not consent to and in fact protested against is a sexual assault.

I am hoping the cops who are responsible for this get jail time.

Not hardly...anal probes are performed every day legally without consent. There is no law or reason to say this was a sexual assault...but there is reason to say it was not legal and thus the settlement.

But no need to quibble...we agree on the result.

Sorry, his protests don't make it sexual assualt. If it did, every incoming prisoner subjected to cavity searches could claim sexual assault. The police did have a warrant, but they also went way overboard in their search.

I'm willing to bet that had he just been subjected to one x-ray, digital (finger) search and one enema, he wouldn't have won his suit.

Because they continued with multiple enemas, whcih could have endangered his life, and the prep for colonoscopy, that is why he won the search. If they couldn't find drugs with and x-ray, finger search and one enema, they weren't going to find any. A HUGE portion og that settlement should be paid by the hospital because the staff had an ethical obligation to inform the officers that if those first three searches didn't. Find narcotics, nothing further would. The police are not trained medical professionals, the hospital staff is.

Went overboard is very much the point.

Maybe they should set the same standard that is in place for pepper spray and Taser certification, and announce that all cops and jailers will have to be on the receiving end at least once a year, or they can't perform cavity searches, etc.

Exactly and lets not forget that this man was never placed under arrest. All of this occurred while he was being "detained" after a routine traffic stop.

From the last thread on this topic, the police had a warrant to be executed in County A - and the hospital there refused to do the procedures due to ethical concerns. The warrant was not good in County B where the hospital was less concerned about ethics.

Additionally, some of the procedures County B hospital performed occurred after the warrant expired at midnight.

And like MsMJAY said, this man was not under arrest at the time.

this case was discussed in this thread: I miss the 4th Amendment

the search was not even legal as the warrant was expired and not valid for the county where the clinic was located.
