Yes, it is discrimination as there is employment discrimination of many varieties most of which is not prohibited by law just as there is discrimination against the unemployed that is not proscribed by law.

There is also age discrimination that is against the law but is practiced regularly and extremely difficult to prove.

It's discrimination, but it's usually legal, unfortunately.

I think that background checks should be limited to crimes that are very relevant for the job. If someone was convicted of selling drugs illegally, for instance, then there's a compelling reason not to hire them as a pharmacist, at least not anytime soon - but s/he shouldn't be barred from jobs that don't involve special access to drugs, like being shift manager at a pizza parlor or repairing cars.

Making it extremely difficult for ex-convicts to find legal jobs with living wages makes it more likely that they'll get involved with illegal activity again, either from desperation to earn money or because they have a lot of time on their hands without a job and very little structure in their daily schedule. Sometimes it's both. So it's better for them, and for everyone around them, if they have equal access to jobs that aren't closely related to their crime.

I don't get this. I really don't.

There are millions and millions of people all over the world that are not gainfully employed with a living wage but they don't turn to illegal activites.
If they cannot exercise personal control and keep out of such illegal activities, they don't deserve a break.

This is why most companies won't, and don't, hire ex-cons.
I think it is perfectly acceptable to do this and I don't class it as any sort of discrimination whatsoever.
If people are stupid enough to choose to get involved in illegal activities, and even more stupid to get caught, and even worse that their particular type of crime lands them a custodial sentence, then they have chosen to throw away any decent employment prospects, any decent interraction with good people in society, and deserve every damned bit of condemnation and bigotry/discrimination that soceiety and employers can throw at them.

Never heard of the expression that leopards don't change their spots??
Whether the prospective employment is related to their crime or not is irrelevant.
The sheer fact that someone chose to engage in an illegal activity just shows how their mindset works and for the vast majority of them, that type of mindset doesn't change.
In essence, that type of person can't be trusted. Period.

I think every employer has a right to inspect, and subsequently reject, anyone who has a criminal record just on the premise that their mindset is not conducive to honesty and high moral judgement and principals.

Discrimination?? Maybe.
But it's wholly justified IMHO and shouldn't be changed... Ever.


Call me a bigot if you like.
But that's my take on it.
