Oops. Another one down.

This time, the victim thought it would be a funny joke to try and destroy the paint on someone's car, and got shot in the head for it.

A bunch of teenagers decided to go pull a supposedly "get even" prank, vandalized a car, only to have the owner of the car (father of their intended victim) open fire on them, killing a passenger in the getaway vehicle.

He's charged with first degree murder.

Just for clarity, this wouldn't be a "stand your ground" situation. It seems that in Arkansas, the castle doctrine extends into the curtilage of the home. If the kiddies had stuck with the toilet paper, it would be pretty clear, but since egging a car makes an easy case of felony vandalism, this dude could get off.

What the hell is wrong with people??? What's wrong with doing this stuff with toilet paper, and running the little shits off with a load of rocksalt from a .410??? The old farmer would take a shot, every time he saw us in his melon patch, but nobody every got killed. (I was told the rock salt stung like hell, though.)

Not to be to obvious but it`s the introduction of firearms into the situation that creates the high level of lethality and escalation.......


Plus a fuck-wit notion that guns solve more problems than they cause.

First of all, Heretic, a 410? Where the hell were you raised? Granny Price used a 12 gauge, and from experience, rock salt burns like hell when you get hit, and worse if you get wet.

I grew up in the country. Pranks were few and far between, but Granny Price had the only property in the county that you could grow decent apple trees on. The fact that the orchard was 20 yards from her back porch, and the Prices had a history of shotguns and rock salt, hell the family still owns the land, but jr dont care if you steal apples, in fact he took the fence down.

Now rival one up raids on our football rivals was a going thing. Never anything permanent, we used that powdered water color stuff from elementary school to paint the field house our school colors, hundreds of dollars of toilet paper on the high school grounds, stuff like that.

But I see your point. Eggs ruin paint jobs on cars, so yeah felony vandalism. However, I fail to see how deadly force was justified.

In Texas, it is still legal to shot people cutting your fences, which nobody has done in years. You can legally shoot someone approaching your camp fire who does not identify himself first, although you cannot have open fires on public lands, and pretty much nobody you dont know will approach your fire on your property, so the law is a bit moot.

I'm all for the right to defend yourself, but shooting someone over egging your car? What the actual fuck is wrong with people?

.410 was what I was told, but I never took the time to get a good look. There is a now car dealership's washrack on what used to be his melon patch, but he grew some of the best watermelon I have ever eaten. I know, stolen watermelons ALWAYS taste better, but these were fantastic.


The news I read on this guy is that he claims he was shooting to scare. He certainly had the wrong load in his gun for the job.

Shooting to scare....

That would indicate he would have been aiming high, if not straight up in the air, IMO.

So, lets say he was aiming high, what were the kids in? A vehicle with a lift kit?

My guess? Loss of basic cultural civility, and then horrific over-reactions from people who feel powerless to stop what gets inflicted on them.

These kids were causing property damage to an individual, just for fun. One quote I saw about the vandals was, "they was trying to be teenagers. (sic)" The shooter claims he wanted to scare them from coming back for another round.

As Jlf and I were discussing, running young miscreants off with firearms isn't automatically a problem, but opening up with a handgun certainly is. He should have called the cops, too. They never would have showed up, but at least the call would have been recorded.

From the little I've seen so far (I'm going to have to hope for a slow lunch hour at work, to hit some pdf files and get read up) Arkansas has a pretty broad interpretation, and includes felonies within the curtilage.

Maybe but this sounds way out of line, and not within the intent of Castle Doctrine.

It's my understanding that eggs, thrown at the glass so there's no small dents, don't do any damage to cars, at all.

I would almost be willing to give this guy a pass if he were actually defending against property damage . From what I've read, that isn't the case and I think the guy over-reacted and should pay the price.
