Deja moo - the feeling that you've been through this bullshit before.

Once again, the dumbass motherfucking judge up in central California has announced that a serial rapist is to be released from the mental hospital, and sent to live here in the high desert portion of Los Angeles county.

Last time around, the owner of the house backed out of the deal under intense local pressure, but that probably won't be the way it goes now. The property seems to have been purchased with housing this miserable fuck specifically in mind.

Should a person like this be placed back among innocent people, or should he die in a cage?

"Hubbart, who has been confined since 1996 under a state law allowing authorities to commit sexually violent predators to state hospitals based on their likelihood of reoffending, will have round-the-clock security monitoring for at least 30 days, will be required to wear an ankle bracelet monitor, and will be subject to regular drug and alcohol testing and lie detector tests, said Santa Clara County Deputy Dist. Atty. Vonda Tracey."

Last time public pressure reversed it. I see they're inviting public comment.

Yes, Muse, it was. Twice, in fact. With this guy being used as prime point in the discussion, the sentencing rules for someone who commits these kinds of crimes have been changed since then. Those laws don't apply retroactively, though. That's what makes this situation difficult

Note that he isn't being released from prison. He has been locked up in a mental hospital since the late 90's.

The public pressure changed that property owner's mind, Muse, not the judge's. I have not seen the scoop on this owner released anywhere in the media. It's a much different sort of person this time.

I hear you on this. I get the concern, and don't disagree per se.

Just to play devil's advocate, there's a difficult legal area when we can keep you confined indefinitely with a label of mental illness. That's what's happening in this case, yes? Not saying it isn't appropriate, but certainly a dangerous tool potentially.

Absolutely, Muse. There isn't an easy answer, and I'll come right out and say that keeping someone locked up because he'll probably hurt someone again is troubling to my civil libertarian instincts.

My suggestion has been to do in this case what was done with a serial killer who had to be released a few years ago. They put him in a travel trailer that was parked on the grounds of a prison. He was free to come and go, but was under intense supervision, and without any neighbors. That one ended in a best case - the police found more old bodies to charge him with, and he committed suicide before they could arrest him and charge him with those murders.

We have a lot of people on those tracking anklets in California, Muse. They aren't as great as the press releases claim. I'm a lot less interested in knowing we'll have plenty of evidence to convict him if he rapes again, than I am in keeping him from raping anyone.

Here is another glitch. The closest town is an unincorporated community called Lake Los Angeles. It is majority Hispanic, and Hispanics are the ethnic group least likely to report a rape.

This guy is 62 years old. How much of a threat is he? I realize he remains a true sleaze and I wouldn't want him as a neighbor either but the fact is these guys do get released eventually and they have to go somewhere.

Yes I know. At 62 there are not only the same problems but the possibility he will feel the
"need" to prove he still has the power ant control. That is actually what I was referring too.

If you are convicted of murder likelihood is you spend the majority if not your whole life in prison. I know a man who is doing life for shooting and killing his daughters rapist. Would I give that man a second chance, in a freaking heartbeat. Any person who commits a sexually deviant crime as rape or molestation deserves to rot in hell. Is my opinion biased, perhaps it is.
