TOS Main Photo Question (Full Version)

I have just re-read through the TOS, looking for the information about not using explicit photos for your primary one. Either my eyes glazed over and I missed it, or it isn't there.

Help please? Point me in the right direction to find it.

I do remember seeing it somewhere because when I read it, about an hour later I signed on to CM on my cell phone and the first pic that came up was some guy's cock, and I remember doing a double take and thinking WTF???

So....if it isn't there.....at least it used to be....

Thank you Mod3 for your suggestion. I actually wanted to refer a stalker to it. He insists on every time I block a profile, opening another, with all his junk and gaping asshole up close and personal. He says I am a prude with anger problems and should not be on the site. I tried to tell him it was against TOS and all he had to do was move them from his primary photo.

Oh well, I'll just block the current profile also. At this point I don't even know if I should report the photos or not, as I can not find the section that dealt with this matter.

smileforme... glad someone else remembers reading it. Always the possibility my mind is further gone than I realize. <grins>

From what I remember, it was never explicitely mentioned in the ToS.
It used to say in the "Upload picture" page to NOT upload explicit photos as the primary one.
I just had a look - it doesn't seem to say that any more.

Ahh.....that is where I saw it....the "Upload Picture" page....
I think it needs to say that again....and on ToS. I'm not trying to be a prude....but most people don't want to be "greeted" with that type of pic....IMO

In this situation, it would be best to contact Support and let them know what's going on, so they can look into the matter. [;)]

I know this is an old topic, but the issue of nudity in the profile pic is something that has come up a few times recently.

I have read the full text of the TOS for both Collarchat and Collarspace (they are the same) and there is no specific prohibition on nudity in the main profile pic.

There IS a possible conflicting statement about "obscene" material in articles 6.3 and 7.3.13, but that may depend on the legal definition of the worb obscene... and is another matter.

As I understand it, the TOS is a legally binding contract between the sites and the user for to use of either site. The user is legally obligated to adhere to the TOS in using the sites. As such though, the user is not legally obligated to any behavior not specified in the TOS.

So, while nudity in the main profile pic may be undersireable, prohibiting it can not be enforced under the current TOS. While the site may have suggested not using nudes for your profile picture and hoped for the best, this may explain why they have not tried to enforce that "suggestion".

Furthermore, given that the TOS provides for amendment, and the Sites have not seen fit to amend the TOS to include this prohibition on nude profile pics, I can only conclude that they don't see it as a big deal... since nude profile pics are entirely common on sites of this nature... and the policing of such a prohibition would be impractical.
