Republicans want to know about the Administration policy of allowing insurers to opt out of current contracts should Obamacare subsidies be struck down in SCOTUS.

There are basically two questions on the impact.

Why is the opt out clause critical; and

Of course the the inevitable desire for ALL documentation related to the clause.

I know that the IRS has said that taxpayers do not have to repay their subsidies should it come to pass, but I wonder how legal that is as well. They go after anyone who owes back taxes, but they have created an exemption that as far as I know doesn't exist in code.
