An argument broke out recently on Facebook over a misidentification. After a fruitless exchange attempting to correct the insistent miscreant, who had indicated an intention to come find her in real life, the victim of the annoyance finally posted an image of herself to resolve the question.

Kristin Holmes, 26, is now facing a year in jail and a $2500 fine under a Virginia law that criminalizes obscene or threatening lanuage online.

Yeah, seriously.

Yes, free speech DOES say you have the right to insult someone.

I did not find the pic threatening, although I am unsure of what is in her mouth.

You don't find posting a picture of pointing a gun, with the caption stating who she is pointing it at, to be threatening?

By that logic, a student posting that he wanted to shoot up his school shouldn't be viewed as making a threat.

Not really.

The student threatening to shoot up his school is known to the school which has a known location.

These two women did not know each other or where each other lived. Hence the posting of the picture, because she was showing that the other person did NOT know her.

Selfie of a stranger. . . with lots of pink. . . with a smile and toothbrush (thanks Kirata!) is not on my, "That is scary" list.

"So you know the difference when u (sic) come find me," sounds like the response to a threat. Personally, I would have added, "twit," to the end.

No, its not threatening. The caption reads in part, "...when u come find me"

Appears to be entirely defensive to me

Her Facebook page is still up btw, looks like FB people didnt find it too threatening

Browsing her pictures, shes quite the looker
